Amends the Illinois Vehicle Code. Provides that a person commits crowding or threatening a bicyclist when a person driving a motor vehicle recklessly drives the motor vehicle unnecessarily close to, toward, or near a bicyclist. Provides that every person convicted of crowding or threatening a bicyclist shall be guilty of a Class A misdemeanor if the violation does not result in great bodily harm or permanent disability or disfigurement to another. Provides that if a crowding or threatening a bicyclist violation results in great bodily harm or permanent disability or disfigurement to another, the person shall be guilty of a Class 4 felony. Provides that a person commits Projecting or throwing missiles at bicyclists, a Class A misdemeanor, when a person projects or throws any missile (defined as any object or substance) at or against a bicyclist. Effective immediately. |

SB 3309: VEH CD-PARKING OBSTRUCTION

Amends the Illinois Vehicle Code. Provides that no property owner shall allow any unreasonable obstruction of a designated aisle or parking place specifically reserved for persons with disabilities after 24 hours following the conclusion of an adverse weather event. Provides that no property owner shall allow the accumulation of debris or large objects, such as trash containers, to unreasonably obstruct any designated aisle or parking place specifically reserved for persons with disabilities without providing suitable and equivalent alternative parking spaces on-site. Provides that a person who violates these provisions shall be guilty of a petty offense and pay fine of not more than $250. Effective January 1, 2011. |

SB 2993: VEH CD-CDL REQUIREMENTS

Amends the Illinois Vehicle Code. Decreases the number of days from 10 to 5 days after receiving a report of an Illinois conviction, or other verified evidence, of any driver from another state, for a violation of any law or local ordinance of this State relating to motor vehicle traffic control, other than parking violations, committed in a commercial motor vehicle, that the Secretary of State must notify the driver licensing authority which issued the person's driver's license of the conviction. Increases the minimum fine from $2,750 to $5,000 for a second or subsequent offense of certain provisions related to commercial motor vehicles, and increases a maximum civil penalty. Provides that certain information relating to a first offender's driving under the influence offense is not privileged when the offender is a commercial driver's license holder and operating a commercial motor vehicle or vehicle required to be placarded as hazardous materials. Makes other changes. Effective immediately. |

Amends the Illinois Vehicle Code. Deletes a provision concerning side window tinting on multipurpose passenger vehicles and adds a provision providing that on vehicles where a nonreflective smoked or tinted glass that was originally installed by the manufacturer on the windows to the rear of the driver's seat, a nonreflective tint that allows at least 50% light transmittance may be used on the vehicle windows immediately adjacent to each side of the driver. Provides that the use of a nonreflective, smoked, or tinted glass or nonreflective film is not allowed on the window's to the rear of the driver if window treatment has been applied to the windows immediately adjacent to each side of the driver. Makes other technical changes. Effective immediately. |

Changes the amount of the continuous surety company bond that a qualified driver exam training school must hold to $10,000 for a non-accredited school, $40,000 for a CDL or teenage accredited school, $60,000 for a CDL accredited and teenage accredited school, $50,000 for a CDL or teenage accredited school with three or more licensed branches, $70,000 for a CDL accredited and teenage accredited school with three or more licensed branches (rather than a $20,000 requirement that applied to all driver exam training schools). Effective January 1, 2011. |

Amends the Illinois Vehicle Code. Provides that an ordinance that provides for the administrative adjudication of automated traffic law (red light) violations shall require that all determinations by a technician employed or contracted by the municipality or county that a motor vehicle committed an automated traffic law violation must be reviewed and approved by a sworn law enforcement officer of the municipality or county issuing the violation. Provides that for automated traffic law enforcement systems installed on or after January 1, 2011, "recorded images" means a video recording showing the motor vehicle and, on at least one image or portion of the recording, clearly identifying the registration plate number of the motor vehicle (instead of the video recording and several other specified types of photographs or electronic images). Provides that if a municipality or county contracts with a private entity for the administration, enforcement, or both of red light violations, the private entity may not collect any fees or charge an additional fee payable to the private entity associated with a red light violation. Effective July 1, 2010. |

Amends the Illinois Vehicle Code and Boat Registration and Safety Act. Defines "boat trailer" in both the Illinois Vehicle Code and Boat Registration and Safety Act. Excludes boat trailers from the registration and certificate of title provisions of the Illinois Vehicle Code. Transfers the registration provisions applicable to boat trailers from the Illinois Vehicle Code to the Boat Registration and Safety Act and provides that the Department of Natural Resources (rather than the Secretary of State) shall administer the registration of boat trailers and collect the flat weight tax applicable to boat trailers. Modifies the certificate of title and transfer provisions of the Boat Registration and Safety Act applicable to watercraft to also make those provisions applicable to certificate of titles for boat trailers. Effective July 1, 2012. |

Provides that a school bus must contain either an operating cellular radio telecommunication device (cell phone) or two-way radio (rather than just a two-way radio) while the school bus driver is in possession of a school bus and provides that the cell phone or two-way radio must be turned on and adjusted in a manner that would alert the school bus driver of an incoming communication request. Provides that a school bus driver may use a cell phone to communicate with school authorities or their designees about any other issue relating to the operation of the school bus or the welfare and safety of any passenger. Deletes a provision concerning the use of cell phone that has a digital two-way radio. Makes corresponding changes in a provision concerning post-trip inspections of school busses. Effective immediately. |

Provides that owners of certain vehicles of the first division may make application to the Secretary of State to have one registration plate issued and displayed on the rear of the vehicle. Provides that the application requirements shall be the same as other vehicles of the first division subject to registration, except that the applicant shall pay an additional registration fee of $250 for each new and renewal registration application. Provides that of the $250 fee, $10 shall be deposited into the State Police Vehicle Fund. |

Amends the Illinois Vehicle Code. Provides that audible signals shall be used to warn pedestrians and other drivers of an authorized emergency vehicle's approach. Provides that the driver of a police vehicle must: (1) activate oscillating, rotating, or flashing lights at all times during an emergency response when the maximum speed limit or other traffic regulations are disregarded; (2) use sirens to warn pedestrians and other persons of his or her approach during an emergency response situation; and when the maximum speed limit or other traffic regulations are disregarded; and (3) drive with due regard for the safety of other persons and exercise due care when operating a police vehicle. Provides that the driver of a police vehicle may use a covert approach during an emergency response situation when the situation dictates such covert approach, but must comply with all traffic laws if not utilizing lights and sirens as required by this Act. Defines "emergency response situation". Effective immediately. |

Amends the Illinois Vehicle Code. Provides that the amendatory Act may be referred to as the Child Bicycle Helmet Safety Law. Provides that it is unlawful for any person under the age of 18 to operate or be a passenger on a bicycle on a highway, multipurpose public path, or other public right-of-way unless at all times when the person is so-engaged he or she wears a protective bicycle helmet of good fit fastened securely upon the head with the straps of the helmet. Provides that it is unlawful for any person to be a passenger on a bicycle on a highway, multipurpose public path, or other public right-of-way unless (i) the person is able to maintain an erect, seated position on the bicycle and is at least one year of age, (ii) the person is properly seated alone on a saddle seat, or (iii) with respect to any person who weighs fewer than 40 pounds, or is less than 40 inches in height, the person can be and is properly seated in and adequately secured to a bicycle safety seat. Provides that it is a civil offense for any parent or legal guardian of a person below the age of 18 to permit the person to operate or be a passenger on a bicycle in an unlawful manner. Provides that it is unlawful to rent or lease any bicycle to or for the use of any person under the age of 18 on a highway, multipurpose public path, or other public right-of-way unless certain conditions are met. Effective immediately. |

Sets forth the requirements for the back-door referendum. Provides that, if the corporate authorities of a county or municipality adopt an ordinance to impose fines or penalties for a violation of an automated traffic law enforcement ordinance to enforce red lights, then the imposition of the fines or penalties by the corporate authorities of the county or municipality is subject to a back-door referendum. Sets forth the requirements for the back-door referendum. Limits home rule powers. |

Amends the Illinois Vehicle Code. Provides that whenever any person has been found guilty of, received a disposition pursuant to the provisions of the Juvenile Court Act of 1987 for, or received a disposition of court supervision for a violation of the Illinois Controlled Substances Act, the Cannabis Control Act, or the Methamphetamine Control and Community Protection Act, the judge of the court in which such conviction is had shall require the surrender to the clerk of the court of all driver's licenses or permits then held by the person, and the clerk of the court shall, within 5 days, forward the licenses, together with a report of such conviction, to the Secretary of State. Provides that the Secretary of State may suspend the driving privileges of a person for such a violation for a period of 6 months for a first offense and a year for a second or subsequent offense within 5 years, and provides that, in either case, the court may order the Secretary of State to issue a judicial driving permit if certain conditions are met. |

Provides that in addition to existing requirements, applicants for a school bus driver permit must not have been convicted of aggravated reckless driving or driving while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof (rather than driving while intoxicated). Deletes a requirement that the Secretary of State forward a certified copy of the record of such action to the motor vehicle administrator in the State where such person resides when a nonresident's operating privilege is suspended or revoked. Renames "driver exam training school" as "driver training school" in the Illinois Vehicle Code and Criminal Code of 1961. Changes the definition of "medical examiner" or "medical practitioner" in the Driver's License Medical Review Law of 1992 to include any person licensed to practice medicine in all its branches in the State of Illinois or any other state (rather than just the State of Illinois). Amends the Illinois Vehicle Code. Provides that the Secretary of State may conduct random drug testing of applicants for instruction permits who are under the age of 18. Provides that the Secretary may not issue a permit to an applicant who tested positive for the presence of any controlled substance or cannabis. Provides that a person who tests positive for any controlled substance or cannabis must be found to be free of controlled substances and cannabis before he or she may receive an instruction permit. Provides that the Secretary of State shall adopt rules for implementing the new provision and shall prescribe an additional fee, to be added to the fees charged for the issuance of a first-time driver's license, to cover the cost of the testing. |

Provides that a school bus must contain an operating two-way radio or celluar radio telecommunication device (rather than a two-way radio only) while the school bus driver is in possession of a school bus. Provides that the prohibitions regarding the use of a wireless telephone in a school or construction zone or sending an electronic message while driving do not apply to a school bus driver while performing his or her official duties. Effective immediately. |

Amends the Illinois Vehicle Code and Consumer Fraud and Deceptive Business Practices Act. Provides that it is a violation of the Illinois Vehicle Code and an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act for a person who owns or operates a tow-truck (a tower) or an employee or agent of a tower to: (i) stop at the scene of a motor vehicle accident or at or near a damaged or disabled vehicle for the purpose of soliciting the owner or operator of the damaged or disabled vehicle to enter into a towing service transaction; or (ii) stop at the scene of an accident or at or near a damaged or disabled vehicle unless called to the location by a law enforcement officer or the owner or operator of the damaged or disabled vehicle. Effective immediately. |

SB 236: VEH CD-LOW-SPEED ELECTRIC BIKE

Amends the Illinois Vehicle Code. Defines a low-speed electric bicycle as a 2 or 3-wheeled device with fully operable pedals and an electric motor of less than 750 watts (one horsepower), whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs 170 pounds, is less than 20 miles per hour. Excludes low-speed electric bicycles from the definition of "motor vehicle". Provides that a person may operate a low-speed electric bicycle only if the person has a valid current Illinois driver's license, regardless of classification, and the person is at least 16 years of age. Prohibits operation of a low-speed electric bicycle at a speed greater than 20 miles per hour upon any highway, street, or roadway. Prohibits operation of a low-speed electric bicycle on a sidewalk. Provides that, except as otherwise provided, the provisions of the Article of the Code dealing with bicycles also apply to low-speed electric bicycles. |

Amends the Illinois Vehicle Code. Changes the definitions of "custom vehicle" and "street rod" in the Illinois Vehicle Code to exclude certain vehicles that have been certified by an inspector of the National Street Rod Association. Provides that upon initial application for title and registration as a custom vehicle or street rod, the owner must have the vehicle inspected by the Secretary of State Department of Police rather than providing proof acceptable to the Secretary of State that, no more than 3 months before the date of the application for registration, the custom vehicle passed a safety inspection that (i) has been approved by the Secretary and (ii) is equivalent to the National Street Rod Association's prescribed vehicle safety inspection. Provides title and registration content requirements for a custom vehicle or street rod. Provides that a vehicle previously titled as other than a custom vehicle or street rod may be issued a corrected title reflecting the custom vehicle or street rod model if it otherwise meets the requirements for the designation. Effective January 1, 2010. |

Amends the Illinois Vehicle Code. Provides that the provisions related to driving while under the influence (DUI) apply to driving any motor vehicle while under the influence. Provides that the suspension and revocation of a person's motor vehicle driving privileges and the person's opportunity for a hearing for a violation of the DUI provisions of the Illinois Vehicle Code also apply to operation of a snowmobile or watercraft while under the influence. Changes the definition of "first offender" to include certain offenses and suspensions related to operating a snowmobile or watercraft under the influence. Amends the Snowmobile Registration and Safety Act and the Boat Registration and Safety Act to change the definition of "first offender" so that the term has the same meaning as it used in the Illinois Vehicle Code. Amends implied consent provisions of the Snowmobile Registration and Safety Act and the Boat Registration and Safety Act to provide that a law enforcement officer must give notice to the Secretary of State when a person refuses to submit to a chemical test and must give additional warnings to the person regarding possible driver's license suspension, and requires the court clerk to send notice to the Secretary of State if the person fails to request a hearing or if the court finds against the person. Makes other changes. Effective immediately. |

Amends the Illinois Vehicle Code, Clerks of Courts Act, and the Unified Code of Corrections to provide that any person who receives court supervision shall pay an additional fee of $30 (instead of $20). Provides that any person who receives a disposition of court supervision for a Vehicle Code violation or a similar local ordinance shall pay an additional fee of $30 (instead of $20). Provides that $20 of the $30 (instead of the $20) shall be deposited into the State Police Vehicle Fund in the State treasury and $10 of the $30 shall be deposited into the Driver's Education Fund. |

SB 1467: VEH CD-SPEED LIMIT 65 MPH

Provides that, unless some other speed restriction has been established under the Code, the maximum speed limit outside an urban district for any vehicle is 65 miles per hour. Deletes language providing that the Department of Transportation may not alter the speed limits on an access-controlled highway to exceed 55 miles per hour for vehicles of the second division weighing 8,001 pounds or more. Effective January 1, 2010. |

Amends the Illinois Vehicle Code. Changes the definition of an all-terrain vehicle to any motorized off-highway device designed to travel primarily off-highway, 50 inches or less in width, having a manufacturer's dry weight of 1,500 pounds or less (rather than 900 pounds or less), traveling on 3 or more non-highway tires (rather than low-pressure tires), designed with a seat or saddle for operator use, and handlebars or steering wheel for steering control, except equipment such as lawnmowers. Defines "recreational off-road vehicle" as any motorized off-highway device designed to travel primarily off-highway, 60 inches or less in width, having a manufacturer's dry weight of 1,500 pounds or less, traveling on 4 or more non-highway tires, designed with a non-straddle seat and a steering wheel for steering control, except equipment such as lawnmowers. Provides that all provisions of the Illinois Vehicle Code that apply to an all-terrain vehicle shall apply the same to a recreational off-highway vehicle. Effective immediately. |

Amends the Illinois Vehicle Code. Defines a "low-speed vehicle" as any 4-wheeled vehicle with a maximum speed greater than 20 miles per hour but not greater than 25 miles per hour, that conforms with federal motor vehicle safety standards set forth for that vehicle. Provides the fee for a certificate of title for a low-speed vehicle is $30 and the registration fee is $18. Removes the requirement that the Secretary of State issue distinctive license plates for electric vehicles and adds the requirement the Secretary of State issue distinctive license plates for low-speed vehicles. Provides rules for the operation of a low-speed vehicle on streets. Provides that it is lawful for any person to drive or operate a low-speed vehicle upon any street in this State where the posted speed limit is 30 miles per hour or less and cross a street that has a posted speed limit of 45 mph or less, unless the Department of Transportation or a unit of local government prohibits the operation of low-speed vehicles on streets by regulation, resolution, or ordinance. Provides that operators of low-speed vehicles operated on streets must have a driver's license and are subject to the mandatory insurance provisions of the Illinois Vehicle Code. Makes other changes. Effective January 1, 2010. |

Provides that a first violation is a petty offense with a fine between $50 and $500, and a second or subsequent offense is a Class C misdemeanor with a fine between $100 and $500. Provides that an installer may install window treatment for a person who is legally permitted, due to medical reasons, to drive with window treatment that would otherwise be illegal and provides that the installer must obtain and store a copy of a doctor's certificate or letter from the person with medical condition in the installer's permanent records. Provides that the Secretary of State shall provide a notice of the requirements of a provision prohibiting driving a motor vehicle with any sign, poster, window application, reflective material, nonreflective material, or tinted film upon the front windshield, sidewings or side windows immediately adjacent to each side of the driver, unless an exception applies, to a new resident applying for vehicle registration. |

Provides that if any portion of a motor vehicle hitch containing a ball mount and hitch receiver extends more than 4 inches beyond the motor vehicle's rear bumper, then the ball mount must be removed from the hitch receiver when the motor vehicle is not being used for towing. Provides that if any portion of a motor vehicle hitch extends more than 4 inches beyond the rear bumper of the motor vehicle and the hitch is composed of a single assembly that cannot be easily removed from the vehicle, then the ball of the hitch must be covered with a red cover. Defines "ball mount", "hitch receiver", and "motor vehicle hitch". |

HB 3713: VEH CD-RED LIGHT ENFORCEMENT

Amends the Illinois Vehicle Code. Provides that an intersection equipped with an automated traffic law enforcement system must have a yellow change interval of 3 to 6 seconds, as described in the Manual on Uniform Traffic Control Devices published by the U.S. Department of Transportation, and the yellow change interval selected upon installation of an automated traffic law enforcement system may not be reduced while the intersection is equipped with the automated traffic law enforcement system. Provides that when a county or municipality is found to have reduced such a yellow change interval, the automated traffic law system shall be suspended for one month for a first violation and 3 months for a second or subsequent violation in addition to a $10,000 fine payable to the Secretary of State. Provides that a county or municipality is found to have reduced such a yellow change interval must conduct a mandatory review of all intersections in the jurisdiction of the county or municipality that are equipped with an automated traffic law enforcement system, send a written report to the Secretary of State certifying compliance, and send a written letter to all persons issued a violation notice in the past 60 days from the automated traffic law enforcement system informing those persons that the county or municipality tampered with the yellow change interval of the intersection equipped with an automated traffic law system. |

Amends the Illinois Vehicle Code. Provides that whenever a driver of the motor vehicle is involved in a motor vehicle accident resulting in personal injury to a pedestrian with 500 feet of the entrance to a school, place of worship, child care institution, or hospital, and the driver is guilty of any offense against laws and ordinances regulating the movement of traffic for the same conduct, the minimum fine for the first offense is $250. Provides that for a second or subsequent violation, the minimum fine is $750, and the Secretary of State may suspend the a operator's driver's license for 90 days. Effective January 1, 2010. |

HB 3982: SCH/VEH CD-TRANSPORT STUDENTS

Amends the School Code and the Illinois Vehicle Code. Removes a provision in the School Code that allows a school district to transport not more than 15 students to and from an interscholastic athletic or other interscholastic or school-sponsored activity in a van. Provides instead that a school district transporting students in grade 12 or below for an interscholastic, interscholastic athletic, or school-sponsored, noncurriculum-related activity that (i) does not require student participation as part of the educational services of the district and (ii) is not associated with the students' regular class-for-credit schedule or required 5 clock hours of instruction shall transport the students only in a school bus, a vehicle manufactured to transport not more than 10 persons, including the driver, or a multifunction school-activity bus manufactured to transport not more than 15 persons, including the driver; allows for a depreciation allowance claim. In the Illinois Vehicle Code, makes changes with regard to the definition of "school bus" and the requirement that every student enrolled in grade 12 or below in a public or private nursery, primary, or secondary school be transported in specified types of vehicles for certain activities. Amends the State Mandates Act to require implementation without reimbursement. Effective July 1, 2010. |

Defines "active duty" in the Illinois Vehicle Code as active duty pursuant to an executive order of the President of the United States, an act of the Congress of the United States, or an order of the Governor. Defines "service member" as a member of the armed services or reserve forces of the United States or a member of the Illinois National Guard. Effective immediately. |

Amends the Illinois Vehicle Code. Provides that a graduated license may not be issued, renewed, or continued to be used by a person who has been convicted of driving without a license in another state or has been convicted under the Use of Intoxicating Compounds Act. Provides that upon a second conviction of driving while the person's driving privileges were revoked or suspended and the revocation or suspension was for the offense of reckless homicide or a similar out-of-state offense, the Secretary of State shall immediately revoke that person's driving privileges for 5 years, and for a third or subsequent conviction of the same, the revocation is permanent. Amends the definition of "first-time offender" in relation to driving under the influence offenses to include any person who has not had his or her driver's license suspended in this State as the result of refusal of chemical testing in another state. Makes other changes. Amends the Child Passenger Protection Act to provide that a Section requiring every person under the age of 18 years to secure a child between 8 and 18 years old in a properly adjusted and fastened seat safety belt or an appropriate child restraint system also applies to each driver over the age of 18 years who was convicted certain traffic violations in the 6 months prior to the driver's 18th birthday (rather than within 6 months of the birthday), until 6 consecutive months have elapsed without an additional violation. Effective immediately. |

HB 2649: VEH CD-DUI-RECKLESS HOMICIDE

Amends the Illinois Vehicle Code. Provides that a person is guilty of a non-probationary Class 3 felony (rather than a Class 4 felony) when the person is convicted of driving under the influence (DUI) of alcohol, other drug or drugs, intoxicating compound or compounds, or any combination thereof (prohibited substances), (rather than the person being convicted of a DUI violation for a second time) and has previously been convicted of reckless homicide or a similar provision of a law of another state in which the person was determined to have been under the influence of prohibited substances as an element of the offense, or in committing a DUI violation, the person was involved in a motor vehicle, snowmobile, all-terrain vehicle, or watercraft accident that resulted in the death of another person, when the DUI violation was a proximate cause of the death. Provides that evidence of a person's blood, urine, breath or other bodily substance concentration of prohibited substances is admissible when gathered by a trained phlebotomist (rather than a trained phlebotomist acting under the direction of a licensed physician) in any civil or criminal action or proceeding arising out of an DUI arrest. Provides that blood or urine tests (rather than only blood tests) performed for the purpose of determining the concentration of prohibited substances are admissible evidence as a business record exception to the hearsay rule in prosecutions for a DUI violation or a similar provision of a local ordinance, or in prosecutions for reckless homicide and makes corresponding changes in the Boat Registration and Safety Act and Snowmobile Registration and Safety Act. Effective immediately. |

HB 2664: VEH CD-EXCESSIVE IDLING FINES

Amends the Vehicle Code, State Finance Act, and Clerks of Courts Act. Increases the fine for an excessive idling violation from $50 to $250 for the first conviction and from $150 to $500 for a second or subsequent conviction within a 12 month period. Specifies how the fines collected shall be distributed and provides alternate distribution procedures for circuit clerks for excess idling violations. Creates the Trucking Environmental and Education Fund as a special fund in the State Treasury. Provides that all money deposited into the Trucking Environmental and Education Fund shall be paid, subject to appropriation by the General Assembly, to the Illinois Environmental Protection Agency for the purpose of educating the trucking industry on air pollution and preventative measures specifically related to idling. Effective immediately. |

Provides that the same set of standards that currently apply to the operation of a neighborhood vehicle on a street, road, or highway apply to all non-highway vehicles. Provides that non-highway vehicles are subject to the mandatory insurance provisions of the Illinois Vehicle Code when operated on a street, road, or highway. HB 914: VEH CD-DUI-BAIID-HEARING

Amend the Illinois Vehicle Code. Provides that the decision whether to rescind (rather than the decision to rescind) an implied consent suspension is based upon the totality of the evidence in a hearing which the Secretary of State has jurisdiction based on implied consent to testing of the person's blood, breath, or urine for the presence of alcohol, drugs, or intoxicating compounds. Adds the offense of aggravated fleeing or attempt to elude a peace officer to the list of violations that if the holder of a Monitoring Device Driving Permit (MDDP) is convicted of or receives court supervision for that violation, the MDDP will be cancelled. Provides that a person who has received a statutory summary suspension and also had a MDDP cancelled, or would have been cancelled had notification of a violation been received prior to expiration of the MDDP, will have their driving privileges suspended for a period of not less than twice the original summary suspension period, or for another specified time period, and during the period of suspension, the person may apply for a restricted driving permit, which must comply with the standards set forth in the Secretary of State's Blood Alcohol Ignition Interlock Device (BAIID) program (instead of only being allowed to operate vehicles equipped with an ignition interlock device). Effective immediately. |

HB 943: VEH CD-DRUG TESTING

Amends the Illinois Vehicle Code. Provides that the Secretary of State may conduct random drug testing of applicants for instruction permits who are under the age of 18. Provides that the Secretary may not issue a permit to an applicant who tested positive for the presence of any controlled substance or cannabis. Provides that a person who tests positive for any controlled substance or cannabis must be found to be free of controlled substances and cannabis before he or she may receive an instruction permit. Provides that the Secretary of State shall adopt rules for implementing the new provision and shall prescribe an additional fee, to be added to the fees charged for the issuance of a first-time driver's license, to cover the cost of the testing. |

HB 980: VEH CD-TRUCK SPEED LIMITS

Amends the Illinois Vehicle Code. Defines "populated area" as all territory inside the boundaries and all territory that is 5 miles outside the boundaries, in any direction, of a city, village, or incorporated town with a population of 50,000 or more, and defines "non-populated area" as territory not included in a populated area. Provides that, in a non-populated area, unless some other speed restriction has been established under the Code, the maximum speed limit outside an urban district for any vehicle weighing over 8,000 pounds is 65 miles per hour (instead of 55 mph). Provides that the maximum speed limit for busses outside an urban area is 55 mph in a populated area and 65 mph in a non-populated area (instead of various speed restrictions from 55-65 mph based on whether the highway was under the jurisdiction of the Illinois Toll Authority). Provides that language providing that the Department of Transportation may not alter the speed limits on an access-controlled highway to exceed 55 miles per hour for vehicles of the second division weighing 8,001 pounds or more applies only in a populated area. Effective January 1, 2010. |

HB 931: VEH CD-CDL-OUT OF SERVCE ORDER

Amends the Illinois Vehicle Code. Provides that no person may drive a commercial motor vehicle on a highway if such person's driving privilege, license, or permit is, among other things, subject to, or in violation of, a "driver or vehicle out of service order" (rather than "out of service order") while operating a vehicle designed to transport "16 or more passengers" (rather than "passengers"), including the driver, or while transporting "hazardous materials required to be placarded" (rather than "hazardous materials"). Exempts the drivers of commercial motor vehicles used primarily in the transportation of propane winter heating fuel and the drivers of motor vehicles used to respond to pipeline emergencies from the commercial driver's license requirements, but only if such requirements would prevent the driver from responding to an emergency condition requiring immediate response, as defined by federal regulation. Disqualifies a person from driving a commercial motor vehicle if that person has been convicted more than once of violating certain combinations of provisions related to out-of-service orders. Increases the minimum and maximum penalties for certain violations of the Uniform Commercial Driver's License Act. |

HB 642: TOLL AND RED LIGHT VIOLATIONS

Amends provisions of the Toll Highway Act and the Illinois Vehicle Code relating to toll violations detected by the Illinois State Toll Highway Authority's video or photo surveillance system and red light violations detected by an automated traffic law enforcement system in a municipality or county. Provides that violation notices must be sent no later than 30 days after the date of the alleged violation. Requires notices to be accompanied by copies of any and all evidence, material, or similar information relevant to the alleged violation. Provides that if the public entity with jurisdiction fails to comply with the violation notice requirements, the alleged violator has an affirmative defense to an alleged violation. Effective immediately. |

HB 795: VEH CD-POLICE VEHICLES-LIGHTS

Amends the Illinois Vehicle Code. Provides that the driver of a police vehicle must use oscillating, rotating, or flashing lights when: (1) parking or standing, irrespective of the provisions of the Code; (2) proceeding past a red or stop signal or stop sign; (3) exceeding the maximum speed limits; or (4) disregarding regulations governing direction of movement or turning in specified directions. Provides that the driver of a police vehicle must: (1) activate oscillating lights, rotating or flashing lights, sirens, or any combination of such lights or sirens during a high speed vehicle response; (2) use lights and sirens to warn pedestrians and other persons of his or her approach during an emergency response situation; and (3) drive with due regard for the safety of other persons and exercise due care when operating a police vehicle. Permits the driver of a police vehicle to use a covert approach when the situation dictates, but requires the driver to reduce speed to conform with the current driving conditions in order to lessen the danger posed to the general public. In connection with provisions concerning the duty of the driver of an authorized emergency vehicle to drive with due regard for the safety of all persons, provides that if an act of reckless disregard causes great bodily harm or death to any person or persons, that act shall be prima facie evidence that the duty of due regard for the safety of all persons was not met. Effective immediately. |

Provides that a person's vehicle is subject to seizure and forfeiture when the person is cited for the offense of driving while driving privileges are revoked or suspended, and the person's driving privileges were revoked or suspended due to the offense of reckless homicide. |

Provides that the Secretary of State shall immediately revoke the license, permit, or driving privileges of any driver upon receiving a report of the driver's conviction of negligent vehicular homicide or aggravated negligent driving. Creates the offense of aggravated negligent driving. Provides that a person commits the offense if the person's negligent operation of a motor vehicle is the proximate cause of a motor vehicle accident that results in a type A injury to another or property damage of another in excess of $1,500. Provides that a violation is a Class A misdemeanor. Amends the Criminal Code of 1961. Creates the offense of negligent vehicular homicide. Provides that a person commits the offense if the person's negligent operation of a motor vehicle is the proximate cause of the death of another person. Provides that a violation is a Class 4 felony. |

Amends the Illinois Vehicle Code. Provides that, beginning July 1, 2010, each school bus that is purchased new shall be equipped with seat safety belts for each passenger. Provides that the State Board of Education shall adopt rules to ensure that school districts require all passengers on those buses to wear seat safety belts. Provides that except for willful and wanton conduct, a school bus driver may not be held personally liable for the failure of passengers to wear seat safety belts. Denies home rule powers. Makes a corresponding change in the Illinois Municipal Code. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately. |

Amends the Illinois Vehicle Code. Creates the offense of distracted driving, which a person commits by operating a motor vehicle in violation of a law or ordinance governing the movement of vehicles while also engaging in certain activities. Provides that a law enforcement officer may charge a person with distracted driving if the officer (i) has stopped the person for any violation of a law or ordinance governing the movement of vehicles and (ii) determines that the person was driving while distracted. Specifies that distracted driving may not be recorded on a person's driving record, but requires a person who has committed distracted driving to pay an additional fine equivalent to the amount of the fine for the underlying offense that he or she committed. |

Amends the Illinois Vehicle Code. Provides that all motor vehicles with two headlights must operate with those headlights turned on at all times, regardless of the time of day or weather conditions, rather than during a period of from sunset to sunrise, at times when rain, snow, fog, or other atmospheric conditions require the use of windshield wipers, and at any other times when, due to insufficient light or unfavorable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 1000 feet. Effective January 1, 2010. |

Provides that where traffic signals are not in place, vehicles must stop and yield to a pedestrian in a crosswalk rather than yielding the right-of-way by slowing down or stopping if need be. Provides that on a school day when children are present and so close that a potential hazard exists because of the close proximity of the motorized traffic and when traffic signals are not in place or in operation, vehicles must stop and yield to a pedestrian in a crosswalk rather than yielding the right-of-way by slowing down or stopping if need be to so yield. Provides that those purposes include the Safe Routes to School Program and safety programs within the School Safety and Educational Improvement Block Grant Program (in addition to the existing purposes of school zone safety education and the purchase, installation, and maintenance of caution lights mounted on school speed zone signs).
