Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois to provide that the Motor Sports Promotion Council Task Force may meet at the call of the Chair or any 4 members (instead of shall meet at least quarterly) and to repeal a Section concerning grants under the Gang Control Grant Act. Amends the Center for Business Ownership Succession and Employee Ownership Act to provide that a Center for Business Ownership Succession and Employee Ownership may be (instead of is) created within DCEO. Amends the Illinois Emergency Employment Development Act to provide that the Governor may (instead of shall) appoint an Illinois Emergency Employment Development Coordinator within DCEO. Repeals the Gang Control Grant Act. Amends the Board of Higher Education Act to provide that the Board and DCEO may (instead of shall) conduct an economic and educational feasibility study for the future development of Parks College in Cahokia, Illinois.

Provides that an employer who receives a request for records of a disciplinary report, letter of reprimand, or other disciplinary action in relation to an employee under the Freedom of Information Act may provide notification to the employee in written form or through electronic mail, if available. Effective immediately.

SB 3206: PROCUREMENT-CAPITAL DEV BOARD (Assigned 4/8/2010)
Amends the Illinois Procurement Code. In a Section requiring separate bids for subdivisions of work for construction contracts in excess of $250,000, permits the waiver of the requirement during the next 4 years (now, 3 years) for Capital Development Board projects if specified conditions are met. Effective immediately.

Provides that information concerning a non-existent address used to obtain an identification card is false information for the purposes of a particular provision of the Act. Amends the Illinois Vehicle Code. Provides that information concerning a non-existent address used to obtain a driver's license or permit is false information for the purposes of a particular provision of the Code. Also makes technical changes.

Amends the Capital Development Board Act. Makes a technical change in a Section concerning the short title of the Act.

SB 3429: CDB-BUILDING ENERGY LABELS (Assigned 4/8/2010)
Amends the Capital Development Board Act. Requires the Board, in consultation with the Department of Commerce and Economic Opportunity, to initiate a study of building energy performance measures for the purposes of identifying a simple and easily understood label for a building or facility that indicates its energy use. Provides for the Board to identify no less than 10 buildings to serve as case studies. Requires the Board to report its findings and recommendations to the General Assembly. Effective immediately.

SB 3214: JOLIET ARSENAL AUTHORITY-BOARD (Assigned 4/8/2010)
Amends the Joliet Arsenal Development Authority Act. Provides that the Board of the Joliet Arsenal Development Authority shall consist of 10 members (now, 9 members). Sets forth the membership of the Board. Provides that the County Executive of Will County, with the advice and consent of the Will County Board, shall appoint 6 members of the Board (now, the Will County Board appoints 5 members). Provides that the Authority shall be abolished upon the last to occur of the following: (i) expiration of the 25-year period (now, 15-year period) that began on the effective date of the Act; or (ii) one year after all revenue bonds, notes, and other evidences of indebtedness of the Authority have been fully paid and discharged or otherwise provided for. Effective immediately.

SB 3418: MUSIC PYROTECHNIC TASK FORCE (Assigned 4/8/2010)
Amends the Pyrotechnic Distributor and Operator Licensing Act. Increases the total number of members for the Music Entertainment Pyrotechnics Task Force to 9 members (now, 5 members). Provides that the President of the Senate and the Minority Leader of the Senate shall each appoint 2 members to the Task Force. Effective immediately.

SB 2798: VEH CD-SHARE THE ROAD PLATES (Assigned 4/8/2010)
Amends the State Finance Act to create the Share the Road Fund. Amends the Illinois Vehicle Code. Provides for the issuance of Share the Road license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $22 at original issuance and at renewal. Provides that $17 of the additional original issuance fee and $20 of the renewal fee shall be deposited into the Share the Road Fund. Provides that $5 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation, the moneys in the Share the Road Fund shall be paid as grants to the League of Illinois Bicyclists for educational programs instructing bicyclists and motorists on how to legally and more safely share the roadways.

SB 3576: PROCUREMENT-SMALL LEASES (Assigned 4/8/2010)
Amends the Illinois Procurement Code. Exempts the procurement of leases of property of less than 10,000 square feet with rent of less than $100,000 per year from the required use of the request for information method of procurement (now, procurement is exempt if the lease is of property of less than 10,000 square feet or for rent of less than $100,000 per year). Effective immediately.

SB 3531: IHDA-TAX CREDITS-DONATIONS (Assigned 4/8/2010)
Amends the Illinois Housing Development Act. Provides that the term "administrative housing agency" means either the Illinois Housing Development Authority, an agency of the City of Chicago, or the Chicago Board of Education (rather than the Authority or an agency of the City of Chicago). Provides that the City of Chicago and the Chicago Board of Education (rather than the City of Chicago) shall receive 21.5% and 3%, respectively (rather than 24.5%), of the total tax credits authorized for each fiscal year under the Illinois Income Tax Act.

SB 3491: POLICE TRAINING-INVESTIGATORS (Assigned 3/22/2010)
Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Requires that the Department of State Police provide training in death and homicide investigation for State police officers. Provides that only State police officers who successfully complete the training may be assigned as lead investigators in death and homicide investigations. Provides that the satisfactory completion of the training shall be evidenced by a certificate issued to the officer by the Department. Amends the Illinois Police Training Act. Requires that the Illinois Law Enforcement Training and Standards Board conduct or approve a training program in death and homicide investigation for the training of law enforcement officers of local government agencies. Provides that only law enforcement officers who successfully complete the training program may be assigned as lead investigators in death and homicide investigations. Provides that the satisfactory completion of the training program shall be evidenced by a certificate issued to the law enforcement officer by the Illinois Law Enforcement Training and Standards Board. Effective January 1, 2012.

SB 3505: CIVIC CENTER SUPPORT (Assigned 3/22/2010)
Amends the Metropolitan Civic Center Support Act. Provides that, if the State has issued its bonds on behalf of a local Civic Center Authority to help fund the construction of the Authority's facilities, if those bonds have been outstanding for at least 10 years, and if the board of trustees or the city council of the village or city where the Civic Center Authority is located makes a finding in a duly adopted ordinance that it is no longer feasible to operate or cause the facilities of the Authority to be operated in such a manner that, collectively, they will earn sufficient revenues for the Authority to pay all of its operating costs, then the board of trustees or city council may, at its option, apply to the State for relief from the terms of Support Agreements between the State and the Authority. Sets forth procedures for application, payment of principal and interest, deposits for payments, and dissolution of the Civic Center Authority. Effective immediately.

SB 3023: VEH CD-PURPLE HEART PLATES (Assigned 3/22/2010)
Amends the Illinois Vehicle Code. Provides that the Secretary of State must make a version of the special Purple Heart registration plate in a form appropriate for motorcycles.

SB 3288: ST FINANCE-FISCAL YEAR LIMIT (Assigned 3/22/2010)
Amends the Department of Central Management Services Law and the State Finance Act. Exempts payments under plans of the Department of Central Management Services for certain liability and indemnification claims and final judgment settlements from the prohibition against expenditure in a fiscal year of moneys appropriated in an earlier fiscal year. Effective immediately.

SB 3372: APPELLATE PROSECUTOR (Assigned 3/22/2010)
Amends the State's Attorneys Appellate Prosecutor's Act. Provides that the Office of the State's Attorneys Appellate Prosecutor is a judicial agency of State government. Provides that each elected member of the board of governor's of the Office shall serve for a term of 2 years commencing upon their election and until their successors are duly elected or appointed and qualified. Provides that all full-time legal personnel (rather than staff attorneys and deputy directors) shall devote full time to their duties and may not engage in the private practice of law except for part-time staff. Eliminates the power of the Office to hire investigators. Repeals provisions relating to a county's participation in programs of the Office. Effective immediately.

SB 3037: LOTTERY-TICKET FOR THE CURE (Assigned 3/22/2010)
Amends the Illinois Lottery Law, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, and the State Finance Act. Changes the name of the "Ticket For The Cure Fund" to the "Carolyn Adams Ticket For The Cure Grant Fund". Effective immediately.

Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the short title.

SB 3281: COMPTROLLER-UNFUNDED PROGRAMS (Assigned 3/22/2010)
Amends the State Comptroller Act. Requires that State agencies under the Governor's jurisdiction annually report to the Comptroller their programs and program expansions created by State statute that have been unfunded for the previous 3 fiscal years. Requires the Comptroller annually to file a compilation of that information with the Governor and General Assembly.

SB 3289: AUDIOLOGIST-TRANSFER FEES (Assigned 3/22/2010)
Amends the Illinois Speech-Language Pathology and Audiology Practice Act. Provides that all fees and fines collected under the Act shall be deposited into the General Professions Dedicated Fund (now, there is an exception for the Hearing Instrument Consumer Protection Fee). Provides that on December 1 of each year, the Department of Financial and Professional Regulation shall transfer from the General Professions Dedicated Fund to the Hearing Instrument Dispenser Licensing and Discipline Fund an amount equal to all the fees collected for the licensure and renewal of audiologists since the previous December 1. Effective immediately.

SB 2630: ELECTRONIC RECORDS ACT (Assigned 3/22/2010)
Creates the Government Electronic Records Act. Authorizes and requires the use of electronic records in the executive branch, rather than hard copy, if appropriate. Sets forth exceptions and opt-out provisions. Requires the adoption of rules. Amends the State Records Act concerning retention of electronic records. Effective July 1, 2011.

SB 3183: GOVT ETHICS-ECONOMIC INTERESTS (Assigned 3/22/2010)
Amends the Illinois Governmental Ethics Act. With respect to required notification of certain persons who must file statements of economic interests with a county clerk, permits the county clerk to send the notices electronically (now, may send notices only by U.S. mail).

HB 5358: PUB OFFICER COMP SUSPENSION (Assigned 3/15/2010)
Creates the Elective Office Compensation Suspension and Forfeiture Act. Requires the suspension of the compensation of a person in an elective office who is charged with a criminal offense. Requires the suspension during the pendency of the charge, and specifies the events that terminate the suspension. Requires forfeiture of the suspended compensation unless the charge is dismissed, the person is acquitted, or the person's conviction is reversed. Effective immediately.

HB 5424: VETERANS-NO FEE ID CARDS (Assigned 3/15/2010)
Amends the Illinois Identification Card Act, Vital Records Act, and Illinois Vehicle Code to provide that if a military veteran who is currently participating in a skills training, rehabilitation, or employment program that is either operated by a State agency or operated by a non-State organization that is currently receiving grant funds from the State for the purposes of the program makes a written request or application for a copy or a certified copy of a birth certificate, a driver's license or the renewal of a driver's license, or an identification card, then the military veteran shall not be charged any fee for such request or application. Provides that the Secretary of State in consultation with the Department of Public Health shall develop rules to implement the provisions concerning fee waivers for military veterans participating in skills training programs. Contains a nonacceleration clause.

Amends the Deposit of State Moneys Act. In provisions authorizing the State Treasurer to consider a financial institution's commitment to its community in deciding whether to deposit State funds in that institution, provides that the State Treasurer shall not deposit funds in the institution (i) if the current rating under the federal Community Reinvestment Act of 1977 is less than "outstanding" and (ii) unless the financial institution certifies that it does not make refund anticipation loans and does not make operating loans to payday lenders.

Amends the Freedom of Information Act. With respect to the disclosure exemption for administrative enforcement and law enforcement records, extends the exemption to records the disclosure of which would affect enforcement proceedings and investigations of any public body (now, the public body that receives the request). Requires a public body that receives any administrative enforcement or law enforcement records request but that is not the public body or law enforcement or correctional agency contemplating or conducting a proceeding or investigation to transmit the request to such body or agency. Effective immediately.

HB 5748: CHARITABLE ORG-STATE PAYMENTS (Assigned 3/2/2010)
Amends the State Finance Act. Provides that any voucher submitted by a State agency to the Comptroller for payment must indicate on the voucher whether the payee is a charitable organization. "Charitable organization" is defined as an organization exempt from federal taxation under Section 501(c)(3) of the Internal Revenue Code. Requires the Comptroller to maintain a database, by State fiscal year, of all vouchers submitted for payments to charitable organizations. The information in the database for each voucher must include the State agency issuing the voucher, the name of the organization, the address of the organization, the reason for or purpose of the payment, and the source of funds. If available, the information should also include the name of the head of the organization. The database must be accessible on the Internet through a link on the home page of the Comptroller's website and must be searchable by each category of data entry. The Comptroller is authorized to adopt rules to implement and administer this provision.

HB 5802: ILLINOIS ENTERPRISE COMMISSION (Assigned 3/2/2010)
Creates the Illinois Enterprise Commission Act. Provides for each legislative leader to appoint 3 public members to the Commission. Authorizes employment of an executive director and staff. Requires the Commission and its staff to scrutinize the existing Illinois laws and administrative rules to see which rules are serving as a net drag on Illinois job creation and economic productivity. Requires the Commission to annually adopt, by two-thirds majority vote, and submit to the Governor, the General Assembly, and the executive director of the Joint Committee on Administrative Rules (JCAR), an omnibus list of all of the administrative rules within the Illinois Administrative Code that the Commission believes can be repealed, abolished, or amended to maximize the wealth and productivity of Illinois. Allows for public comment. Requires the Commission to recommend replacement rules. Allows JCAR, by a single, up-or-down record vote, to accept a report by a three-fifths majority, which has the effect of prohibiting the rules on the list. Sets forth a procedure for adoption of recommended or other rules as emergency rules. Requires the Commission to annually adopt, by two-thirds majority vote, and submit to the Governor, the General Assembly, and the executive director of the Legislative Reference Bureau (LRB), an omnibus list of all of the laws, and sections of laws, within the Illinois Compiled Statutes that the Commission believes can be repealed, abolished, or amended to maximize the wealth and productivity of Illinois. Allows for public comment. Requires the Commission, in cooperation with LRB, to oversee the drafting of an omnibus revisory bill reflecting the Commission's recommendations. Repeals the Act on January 1, 2015. Effective immediately.

HR 907: URGES CITIZENS - 2010 CENSUS (Assigned 3/2/2010)
Urges the citizens of the State of Illinois to complete the Census 2010 questionnaire by April 1, 2010 to ensure that Illinois is fully and completely represented and urges all public officials in Illinois to cooperate fully with the U.S. Census Bureau and assist the Bureau with its efforts to make a complete count in Illinois.

HR 919: UNIV PROCUREMENT COMMISSION (Assigned 3/2/2010)
Resolves that the Board of Higher Education shall establish a commission to study ways in which the Illinois Procurement Code may be revised so that purchases by public universities can be completed more efficiently.

HB 6045: FINANCE-CONSERVATION FUND (Assigned 3/2/2010)
Amends the State Finance Act. Provides that conservation practice cost-share grants from the Partners for Conservation Fund may be made to livestock operations. Effective July 1, 2010.

HB 6272: LOCAL INITIATIVE-PROCEDURES (Assigned 3/2/2010)
Creates the Local Initiative Sunshine Act. Defines "gubernatorial or legislative member initiatives". Provides that executive branch State agencies processing initiatives must establish and maintain a file for all applications. Specifies the information an agency must obtain during the application or review process. Provides that an agency that processes grants shall develop guidelines and monitoring procedures. Specifies the required guidelines and procedures. Provides for public disclosure of grant information.

HB 6268: GOMB-ECONOMIC & FISCAL REPORT (Assigned 3/2/2010)
Amends the Governor's Office of Management and Budget Act. Provides that, by January 1 of each year, the Office shall submit an economic and fiscal policy report to the General Assembly. The report must outline the long-term economic and fiscal policy objectives of the State, the economic and fiscal policy intentions for the upcoming fiscal year, and the economic and fiscal policy intentions for the following 2 fiscal years. The report must highlight the total level of revenue, expenditure, deficit or surplus, and debt with respect to each of the reporting categories. The report must be posted on the Office's Internet website and allow members of the public to post comments concerning the report. Effective immediately.

HB 4985: ELECTRONIC RECORDS ACT (Assigned 3/2/2010)
Creates the Government Electronic Records Act. Authorizes and requires the use of electronic records in the executive branch, rather than hard copy, if appropriate. Sets forth exceptions and opt-out provisions. Requires the adoption of rules. Amends the State Records Act concerning retention of electronic records. Effective July 1, 2011.

HB 5065: BUSINESS ENTERPRISE-EXTEND (Assigned 3/2/2010)
Amends the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. Extends the repeal of the Act from June 30, 2010 to June 30, 2012. Effective immediately.

HB 4928: OPEN MEETINGS-ELDER ABUSE (Assigned 3/2/2010)
Amends the Open Meetings Act. Permits a closed meeting for an elder abuse fatality review team's review of a death in which abuse or neglect is alleged, suspected, or substantiated. Effective immediately.

Amends the Open Meetings Act. Requires a public body to make proposed minutes of an open meeting available for public inspection within 8 business days after the meeting to which the minutes relate and make approved minutes of an open meeting available for public inspection within 5 business days after approval (now, make available within 7 business days after approval).

HB 5171: VEH CD-MILITARY PLATES-NO FEE (Assigned 2/23/2010)
Amends the Illinois Vehicle Code. Deletes language requiring the payment of fees, in addition to the to the applicable registration fee, for Korean War Veteran, U.S. Veteran, Vietnam Veteran, World War II Veteran, Army Combat Veteran, and U.S. Army Veteran special license plates.

HB 6052: LOC GOV/SCHOOL-ENERGY CONSERV (Assigned 2/23/2010)
Amends the Local Government Energy Conservation Act, the School Code, and the Public University Energy Conservation Act. Provides that requests for proposals must be submitted to the administrators of the Capital Development Board Procurement Bulletin for publication. Provides that contracts let or awarded must be submitted to the administrators of the Capital Development Board Procurement Bulletin for publication. Makes changes concerning drafters of specifications submitting bids or proposals for installment contracts and other agreements proposed by a unit of local government, school district, vocational center, or public university. Provides that any consultant, architect, engineer, or other drafter of specifications who assists a unit of local government, school district, or vocational center in the preparation of specifications shall not submit a bid or proposal to meet the procurement need unless the body authorizing the contract or agreement determines in writing that there will be no substantial conflict of interest. Makes other changes. Effective immediately.

HB 2500: PUBLIC WORKS SURETY BOND (Assigned 2/23/2010)
Amends the Public Construction Bond Act. Authorizes a public body to waive or lower the requirement of a surety bond for a public construction contract if the contractor is a small business enterprise. Defines a small business enterprise.

HR 547: TINNITUS AWARENESS (Assigned 2/23/2010)
Encourages interested groups and affected persons to promote public awareness of tinnitus, the dangers of loud noise, and the importance of hearing protection for all individuals; and commit to continuing its support of innovative hearing health research, so that treatments for tinnitus can be refined and a cure for tinnitus can be discovered. Designates the month of May as Tinnitus Awareness Month in order to raise public awareness and to further its mission to silence tinnitus through education, advocacy, research, and support.

Amends the Green Buildings Act. Establishes the Green Buildings Task Force within the Capital Development Board to evaluate the State's financial and environmental costs and achievements under the Act through fiscal year 2015 and as anticipated through fiscal year 2020. Requires the Task Force to report its evaluation and recommendations for legislative changes to the Governor and General Assembly by December 31, 2016.

HB 6138: CD CORR-COMMISSARY ACCOUNT (Assigned 2/22/2010)
Amends the Unified Code of Corrections. Provides that the Department of Corrections and the Department of Juvenile Justice shall each suspend all commissary accounts of committed persons under their custody for a period of 2 years after the effective date of the amendatory Act.

HB 4991: STATE EMPLOYMENT APPLICATION (Assigned 2/22/2010)
Creates the State Employment Application Act. Provides that an application for State employment may not contain any question as to whether the applicant was convicted of or placed on supervision for a non-violent criminal offense but must contain a question as to whether the applicant for State employment has ever been convicted of a violent offense that is classified as a felony. Provides that nothing in the Act shall be construed to prohibit a State agency from conducting a criminal background check of an applicant for State employment. Provides that if a federal or State law disqualifies a person convicted of certain offenses from holding a position, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that if an applicant is applying for a position of peace officer, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that nothing in the Act prohibits a decision to refuse to hire on the basis that the applicant has been convicted of a criminal offense. Effective immediately.

HB 6262: ST ETHICS-PUBLIC SERVICE ADS (Assigned 2/22/2010)
Amends the State Officials and Employees Ethics Act. Prohibits a public service announcement on behalf of a State administered program that contains the proper name, image, or voice of a State executive branch constitutional officer or legislator from being displayed on a billboard or electronic message board. Effective immediately.

HB 6267: COMPTROLLER-CAFR DEADLINE (Assigned 2/22/2010)
Amends the State Comptroller Act. Requires that the Comptroller publish each comprehensive annual financial report (CAFR) within 6 months after the end of the fiscal year to which the report relates. Requires that the Comptroller give notice of a publication delay to the Governor and legislative leaders and on the Comptroller's official website. Effective July 1, 2010.

HB 6003: VEH CD-MULTIPLE SCLEROSIS PLTS (Assigned 2/22/2010)
Amends the Illinois Vehicle Code. Provides for the issuance of Multiple Sclerosis Assistance license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $40 at original issuance and $27 at renewal. Provides that $25 of the additional original issuance fee and the renewal fee shall be deposited into the Multiple Sclerosis Assistance Fund, a special fund in the State treasury. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund.

HB 6153: DCEO-TECHNOLOGY INCENTIVES (Assigned 2/22/2010)
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Authorizes the Department of Commerce and Economic Opportunity, subject to appropriation, to create financial incentive and grant programs to encourage private companies to share their new energy technologies with public institutions of higher education, public utilities, State agencies, and federal agencies.

HB 5329: OPEN MEETINGS-TRANSIT DISTRICT (Assigned 2/22/2010)
Amends the Open Meetings Act. Permits a municipal transit district with jurisdiction over more than 4,500 square miles to include members participating in a video conference at specified locations when determining the physical presence of a quorum at an open meeting. Provides that the requirement that members of a public body with less than statewide jurisdiction be physically present at a closed meeting does not apply to a municipal transit district with jurisdiction over more than 4,500 square miles.

HB 4836: SUNSHINE COMMISSION ACT (Assigned 2/22/2010)
Creates the Sunshine Commission Act. Provides for the appointment by the legislative leaders of a Sunshine Commission, consisting of 4 legislators and 4 public members, to conduct a thorough review of the relevance, efficiency, and effectiveness of each "State executive branch program". Requires the Commission to report its recommendations to the General Assembly within 6 months after the Act's effective date. Requires the General Assembly, by joint resolution, to approve or reject the report within 60 session days after the report is filed. Repeals the Act 2 years after its effective date. Effective immediately.

HB 4858: STATE ID-DRIVERS LICENSE (Assigned 2/22/2010)
Amends the Illinois Identification Card Act and the Illinois Vehicle Code. Provides the Secretary of State may require an applicant to utilize the same residence address and name on a State identification card, driver's license, and instruction permit. Provides that the Secretary of State may allow applicants for a driver's license or State identification cards to provide a mailing address in addition to a residence address. Provides that the Secretary of State may adopt rules regarding the use of foreign language interpreters during the application and examination process. Effective immediately.

HB 5854: FINANCE AUTHORITY-PROJECTS (Assigned 2/22/2010)
Amends the Illinois Finance Authority Act. Provides that the Act applies to certain projects located outside of the State, if the project involves property or facilities that are owned, operated, leased, or managed by an entity located within the State. Sets forth criteria for approving out-of-State projects. Provides that the Authority shall not provide financing for any project, or portion of a project, located outside of the United States. Provides that the Authority shall not provide financing that constitutes an indebtedness of the State for any project, or portion of a project, located outside of the State. Provides that the Illinois Finance Authority may approve an application to finance or refinance a project located outside of the State only if the Authority has the ability to issue at least another $1,000,000,000 of bonds after giving effect to the financing or refinancing or the out-of-state project. Proposes that the Authority shall not provide financing that uses State volume cap under Section 146 of the Internal Revenue Code of 1986 for a project located outside of the State. Effective immediately.

HB 4859: MOTOR VEH-DRIVING PRIVILEGES (Assigned 2/22/2010)
Amends the Illinois Vehicle Code to provide that in certain undue hardship cases where a person's driving privileges have been suspended or revoked, the Secretary of State may issue a restricted driving permit to allow a person to transport children, elderly persons, or disabled persons who do not hold driving privileges and are living in the person's household (rather than just children living in the person's household) to and from daycare. Amends the Unified Code of Corrections. Provides that during a sentencing hearing, the court must make a finding of whether a motor vehicle was used in the commission of the offense for which the defendant is being sentenced. Provides that in cases in which the court finds that a motor vehicle was used in the commission of the offense, the clerk of the court shall, within 5 days thereafter, forward a report of such conviction to the Secretary of State.

HB 6299: FINANCE-E. ST. L. FINANCE AUTH (Assigned 2/22/2010)
Amends the State Finance Act. Creates the East St. Louis Financial Advisory Authority Trust Fund as a special trust fund in the State treasury. Provides for the Authority to transfer money into the Fund. Allows the Authority to expend moneys from the Fund for any legal expense of the Authority, including its personnel costs. Deems its employees to be State employees. Provides that the Fund is not subject to appropriation. Effective immediately.

HB 5455: IEMA-RADIO-EMERGENCY SERVICE (Assigned 2/17/2010)
Amends the Illinois Emergency Management Agency Act. Creates the Radio Amateur Civil Emergency Service (RACES), within the Illinois Emergency Management Agency, to provide emergency communications service in the State. Requires the Director of the Illinois Emergency Management Agency to appoint a State RACES officer to serve as the point of contact between the Illinois Emergency Management Agency and the Illinois amateur radio community, appoint a Deputy State RACES officer, identify amateur radio operators to staff the State Emergency Operations Center when necessary, and serve other functions. Specifies the duties of the Regional RACES officers. Authorizes the appointment, and specifies the duties, of county and municipal RACES officers. Defines when RACES stations may be activated.

HB 6253: USE/OCC-FIREWORKS (Assigned 2/17/2010)
Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that 80% of the proceeds attributable to the sale of fireworks shall be deposited into the Common School Fund. Provides that the remainder shall be deposited into the State and Local Sales Tax Reform Fund (in the case of proceeds collected under the Use Tax Act and the Service Use Tax Act) or the County and Mass Transit District Fund and the Local Government Tax Fund (in the case of the Service Occupation Tax Act and the Retailers' Occupation Tax Act).

HB 4685: SCH CD-ELIMINATE GA SCHOLRSHP (Assigned 2/17/2010)
Amends the School Code. Provides that after June 1, 2010 persons may not be nominated for General Assembly scholarships and that General Assembly scholarships may not be awarded after that date unless the nomination is made prior to that date. Prevents both second nominations for any lapsed General Assembly scholarship and nominating persons to the unused or unexpired parts of any vacated General Assembly scholarship after June 1, 2010. Effective immediately.

HB 5453: STATE POLICE-BLUE ALERT SYSTEM (Assigned 2/17/2010)
Requires the Department of State Police to develop a coordinated program for a statewide emergency alert system, known as the Blue Alert System, to notify persons in the State when a peace officer has been assaulted and the person or persons who perpetrated the assault have not been arrested. Creates a Blue Alert System Task Force to monitor and review the implementation and operation of the Blue Alert System. Requires the Department to conduct a public education campaign about the Blue Alert System. Provides for the appointment of a Blue Alert System Coordinator. Defines "peace officer".

HB 4633: SCH CD-REPEAL GA SCHOLARSHIPS (Assigned 2/17/2010)
Amends the School Code. Provides that, beginning on July 1, 2011, no scholarships may be awarded under provisions that permit members of the General Assembly to award scholarships to persons for attendance at a State sponsored university. A scholarship awarded before July 1, 2011 is valid until its stated term expires, but may not be renewed. Effective July 1, 2011.

HB 5232: LEGAL NOTICES-PUBLICATION-WEB (Assigned 2/17/2010)
Amends the Notice By Publication Act and the Newspaper Legal Notice Act. Provides that if there is no newspaper published in the county where a unit of local government or school district is located, notice by publication shall be given in a secular newspaper located in an adjoining county having general circulation within the unit of local government or school district. Provides that whenever notice is required by law, order of court, or a contract to be published in a newspaper, the newspaper publishing the notice shall, at no additional cost to government, place the notice on the statewide website established and maintained as a joint venture of the majority of Illinois newspapers as a repository for the notices. Includes, in the definition of "newspaper", a requirement that the newspaper have the capability of placing notices on a daily or weekly basis on the statewide website established and maintained as a joint venture of the majority of Illinois newspapers as a repository for the notices. If, after the effective date, there is a notice that is required by law or order of court to be published in a particular unit of local government or school district and there is no newspaper published in the territory of the local government or district, or, in the county in which the local government or district is located, the notice shall be published in a secular newspaper that is published in an adjoining county having general circulation within the unit of local government or school district. To the extent that there is a conflict between the provisions of this amendatory Act and any other provision of law, these provisions control. Effective January 1, 2011.

HB 6194: DFPR-LICENSE FORM WAIVER (Assigned 2/17/2010)
Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Notwithstanding any other provision of law to the contrary, provides that any license application or renewal form that the Department provides to a person shall include a waiver that gives the person the option to grant or deny permission to the Department to sell his or her information, as part of the roster of information including, but not limited to, his or her name, address, and profession, to a third party. Provides that the waiver shall clearly present this option and require the person to check a box marked "Yes" or a box marked "No". Effective immediately.

HB 5230: DEVELOPMENT ASSISTANCE-NOTIFY (Assigned 2/17/2010)
Amends the Corporate Accountability for Tax Expenditures Act. Provides that each recipient of development assistance shall file an annual consolidated progress report (instead of a progress report for each development assistance agreement). Provides that the progress report may include other information the Department deems necessary to ensure compliance with a development assistance program. Amends the Build Illinois Bond Act. Provides that businesses that receive certain grants or loans must notify the Department if the business fails to meet the agreed employment or investment conditions of the grant or loan.

Amends the Open Meetings Act. Provides that, for the purposes of the Act, "public body" does not include a Metropolitan Enforcement Group (MEG) Policy Board or any combination of law enforcement agencies established to enforce the penal laws of the State. Effective immediately.

HB 4569: PERSONNEL RECOMMENDATIONS (Assigned 2/16/2010)
Amends the Illinois Governmental Ethics Act. Requires all references and recommendations concerning any individual for nomination, appointment, or employment (i) as a member or employee of an executive board or commission or (ii) as an official or employee of an executive State agency to be made in writing and signed by the individual or entity making the reference or recommendation. Provides that the references and recommendations are public documents and open to public inspection and copying. Defines "executive board or commission" and "executive State agency" the same as those terms are defined in the Officials and Employees Termination Act of 2009. Makes violation a business offense. Effective immediately.

HB 5081: COGFA-MEDICAL CARE COMMITTEE (Assigned 2/16/2010)
Amends the Commission on Government Forecasting and Accountability Act. Creates the Illinois Medical Care Advisory Committee within the Commission on Government Forecasting and Accountability. Provides for members to be appointed by the Joint Committee on Legislative Support Services. The Committee shall review State medical care programs and services provided, arranged, or procured by State agencies, including without limitation the following: the Department of Healthcare and Family Services, the Department of Human Services, the Department of Public Health, the Department on Aging, the Department of Children and Family Services, the Department of Corrections, the Department of Central Management Services, the State Board of Education, the Illinois Comprehensive Health Insurance Plan, and the University of Illinois. Provides for consultation with committees of the General Assembly, reporting, and making recommendations. Contains other provisions. Effective immediately.

HB 5541: FINANCE-HIRING-UNPAID BILLS (Assigned 2/16/2010)
Amends the State Finance Act. Provides that all hiring of employees and contracting for personal services by State agencies is frozen, and no expenditure may be made for the purpose of creating a new State program or expanding an existing State program, until the State Comptroller certifies in writing to the Secretary of State that payment is issued to all State vendors within 30 days after receipt of a proper bill or invoice. Creates an exception for expenditures that are mandated by federal law and hiring and contracting that is necessary to meet an emergency situation. Effective immediately.

HB 5505: APPRENTICESHIP PREFERENCE (Assigned 2/16/2010)
Amends the Personnel Code. Establishes a preference in the form of points to be added to the final grade of a person who has completed a United States Department of Labor Office of Apprenticeship registered apprenticeship program. Requires the Department of Central Management Services to adopt rules and to verify that persons are qualified for the preference. Effective immediately.

HB 5087: DCEO-POLICE STATION LOANS (Assigned 2/16/2010)
Amends the Department of Commerce and Economic Opportunity Law and the State Finance Act. Authorizes the Department to administer a revolving loan program for the construction, rehabilitation, remodeling, and expansion of police stations and the acquisition of land for the construction or expansion of police stations by police departments. Specifies terms of loans. Creates the necessary special fund in the State treasury. Effective July 1, 2010.

HB 5289: FINANCE-LIBRARY SUPPORT (Assigned 2/16/2010)
Amends the State Finance Act. Creates the Public Library Support Fund. Provides that, within 30 days after the first day of each State fiscal year, the State Comptroller and State Treasurer shall transfer from the General Revenue Fund to the Public Library Support Fund an amount equal $20,000 multiplied by the number of residents of each public library district in the State in which at least 60% of the residents report a household income at or below the federal poverty level. Provides that the Secretary of State shall use moneys in the Public Library Support Fund to make grants to those public library districts. Provides that no public library district may receive more than $20,000 per resident of that public library district from the Fund in any State fiscal year. Effective immediately.

HB 4639: CONSERVE-FOREST DIST-BONDS (Assigned 2/16/2010)
Amends the Conservation District Act and the Downstate Forest Preserve District Act. Provides that "Build America Bonds" issued by a District prior to January 1, 2011 shall mature not later than 30 years after the date of issue. Effective immediately.

Amends the State Designations Act. Provides for the Secretary of State to establish a program by rule to designate, recognize, and award Illinois communities whose citizens have an outstanding record of blood donation, organ donation, or both.

HB 5301: VEH CD-PUBLIC SAFETY DIVER PLT (Assigned 2/16/2010)
Amends the State Finance Act and Illinois Vehicle Code to provide for the issuance of Public Safety Diver special license plates. Creates the Public Safety Diver Fund as a special fund in the State treasury. Provides that the applicant shall pay an additional fee of $45 for original issuance of the plates, of which $30 shall be deposited into the Public Safety Diver Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. Provides that an additional fee of $27 shall be charged for each renewal, of which $25 shall be deposited into the Public Safety Diver Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Public Safety Diver Fund shall be paid to the Illinois Law Enforcement Standards Board for the purposes of providing training, standards, equipment, and facilities to all public safety disciplines involved in public safety diving and water rescue services, with a primary focus toward volunteer responders.

HB 5133: UNIFORM EMERGENC HLTH VOLUNTER (Assigned 2/16/2010)
Creates the Uniform Emergency Volunteer Health Practitioners Act. Provides for the registration of volunteer health practitioners with a registration system for the provision of health or veterinary services in the State for a host entity while an emergency declaration is in effect. Provides for the creation of the registration system. Provides that the Illinois Emergency Management Agency shall be the administrating authority of the uniform Act. Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois to grant the Secretary of Financial and Professional Regulation the power to request the services of emergency volunteer health practitioners registered under the Uniform Emergency Volunteer Health Practitioners Act. Amends the Good Samaritan Act to include volunteers under the Uniform Emergency Volunteer Health Practitioners Act in the list of disaster relief volunteers granted immunity from liability under the Act and to broaden the types of emergency situations in which the immunity applies.

Amends the State Finance Act. Requires the transfer into the Audit Expense Fund of specified amounts from named special funds in the State treasury for the costs of auditing those special funds. Effective immediately.

Creates the Illinois Holocaust and Genocide Commission Act. Provides for the appointment of members by the Governor and for ex officio members. Authorizes the Commission to provide advice concerning education, memorials, events, and other matters. Provides for funding and coordination through the Illinois State Museum and Department of Natural Resources. Repeals the Act on January 1, 2021.

HB 5507: VEH CD-FRATERNAL ORDER PLATES (Assigned 2/16/2010)
Amends the State Finance Act to create the Fraternal Order of Police Fund. Amends the Illinois Vehicle Code. Provides for the issuance of Illinois Fraternal Order of Police license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and at renewal. Provides that $10 of the additional original issuance fee and $23 of the renewal fee shall be deposited into the Fraternal Order of Police Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation, the moneys in the Fraternal Order of Police Fund shall be paid as grants to the Illinois Fraternal Order of Police to increase the efficiency and professionalism of law enforcement officers in Illinois, to educate the public about law enforcement issues, to more firmly establish the public confidence in law enforcement, to create partnerships with the public, and to honor the service of law enforcement officers dedicated to the protection of life and property. Effective immediately

Amends the Limited Liability Company Act. Provides that all fees collected under the provisions concerning a certificate of registration shall be deposited into the General Professions Dedicated Fund.

HB 5109: STATE GUBERNATORIAL PORTRAITS (Assigned 2/16/2010)
Amends the State Designations Act. Designates portraits of Illinois Governors displayed in the State Capitol as the official State portraits of the Governors of Illinois. Prohibits inclusion among those official portraits any image of a Governor who has been removed from office by impeachment and conviction.

HB 5255: AUDIOLOGIST-TRANSFER FEES (Assigned 2/16/2010)
Amends the Illinois Speech-Language Pathology and Audiology Practice Act. Provides that all fees and fines collected under the Act shall be deposited into the General Professions Dedicated Fund (now, there is an exception for the Hearing Instrument Consumer Protection Fee). Provides that on December 1 of each year, the Department of Financial and Professional Regulation shall transfer from the General Professions Dedicated Fund to the Hearing Instrument Dispenser Licensing and Discipline Fund an amount equal to all the fees collected for the licensure and renewal of audiologists since the previous December 1. Effective immediately.

HB 5410: APP DEFENDER-FUNDS (Assigned 2/16/2010)
Amends the State Appellate Defender Act. Provides that for each State fiscal year, the State Appellate Defender shall request a direct appropriation from the Capital Litigation Trust Fund for expenses incurred by the State Appellate Defender in providing assistance to trial attorneys in cases in which the death sentence is an authorized disposition. Makes other changes. Effective immediately.

HB 5956: LINE OF DUTY-FIREMEN (Assigned 2/16/2010)
Amends the Line of Duty Compensation Act. Provides that the person filing a claim for compensation under the Act for a fireman killed in the line of duty shall have access, on a timely basis and in an efficient manner, to all information related to the court's consideration, processing, or adjudication of the claim. Includes in the definition of "eligible late claimant" persons filing a claim for compensation under the Act for a fireman killed in the line of duty.

HB 5191: ADMIN PRO-SMALL BUSINESS (Assigned 2/16/2010)
Amends the Illinois Administrative Procedure Act. Requires that the economic impact analysis for a proposed rule affecting small businesses be prepared by the agency promulgating the rule (now, the Business Assistance Office of the Department of Commerce and Economic Opportunity). Requires each agency to perform periodic reviews of its rules in order to evaluate their affect upon small businesses.

Amends the State Finance Act and the Illinois Vehicle Code. Creates the 4-H Fund as a special fund in the State treasury. Provides for the issuance of 4-H license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $40 at original issuance and $27 at renewal. Provides that $25 of the additional original issuance fee and $10 of the renewal fee shall be deposited into the 4-H Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, the moneys in the 4-H Fund shall be paid as grants to the Illinois 4-H Foundation, a tax exempt entity under Section 501(c)(3) of the Internal Revenue Code, for the funding of 4-H programs in Illinois.

HB 4921: AUDITS-WORKFORCE (Assigned 2/9/2010)
Amends the Illinois Workforce Investment Board Act. Requires the Illinois Workforce Investment Board to annually, as soon as practical after the end of a fiscal year, retain a certified public accountant to perform an external financial and performance audit for that fiscal year and to file the certified audit with appropriate local and State officers and agencies. Effective January 1, 2011.

HB 5170: PROCUREMENT-IDOT-VETERANS (Assigned 2/9/2010)

Amends the General Assembly Article of the Illinois Pension Code. Requires the System to make a quarterly report to the Commission on Government Forecasting and Accountability, which shall include (1) the name and current salary, according to data in the possession of the System, for each participant in the System who (A) first became a member of the System before August 22, 1994; (B) has not begun receiving a retirement annuity under this Article; and (C) is employed in a position covered by a participating system under the Retirement Systems Reciprocal Act and the name of his or her current employer and (2) beginning with the second quarterly report after the effective date, the name of each participant who has begun receiving a retirement annuity under the Article since the preceding quarterly report and, if the salary used to calculate his or her proportional annuity under the Article is higher than his or her highest salary for annuity purposes would have been if he or she were not exempted from the earnings limitation, the salary level used to calculate his or her proportional annuity and the name of his or her employer under the other participating system. Amends the Commission on Government Forecasting and Accountability Act to require that the Commission on Government Forecasting and Accountability submit a quarterly report to the General Assembly that contains information submitted to the Commission by the General Assembly Retirement System. Effective immediately.

Amends the Illinois Vehicle Code and the State Finance Act. Provides for the issuance of U.S. Coast Guard license plates to Illinois residents who meet eligibility requirements to be prescribed by the Secretary of State. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $5 of the original issuance fee and $18 of the renewal fee shall be deposited into the Coast Guard Mutual Assistance Fund. Creates the Coast Guard Mutual Assistance Fund as a special fund in the State treasury. Provides that all moneys in the Coast Guard Mutual Assistance Fund shall, subject to appropriation, be used for grants for charitable purposes and financial assistance programs sponsored by Coast Guard Mutual Assistance, Inc., a recognized charitable organization.

Provides that a person receiving public safety voice or data communication transmitted via the facilities of the State's public safety radio system by wire or radio shall not, without the written authority of the originator of the communication, rebroadcast the communication via any means, including radio or Internet, or otherwise divulge or publish the existence, contents, substance, purport, effect, or meaning thereof. Provides that this provision does not apply to the public safety radio communication transmitted by any system station for the use of the general public, including Amber Alerts and other communications specifically intended for rebroadcast to the public. Provides that radio access to the public safety radio system within the State may only be accomplished upon receipt of written authorization granted by the appropriately licensed authority. Provides that a violation of these provisions is a Class A misdemeanor. Effective immediately.

Amends the Illinois Procurement Code and the Unified Code of Corrections. Provides that if and only if the provisions of House Bill 1994 of the 96th General Assembly that are changed by the amendatory Act become law, to the extent not inconsistent with the function and role of the Illinois Correctional Industries, the Department may enter into a contract, lease, or other type of business agreement, not to exceed 20 years, with any private corporation, partnership, person, or other business entity for the purpose of utilizing committed persons in the provision of services or for any other business or commercial enterprise deemed by the Department to be consistent with proper training and rehabilitation of committed persons. Provides that Illinois Correctional Industries shall have a chief financial officer who shall report to the chief executive officer. Effective July 1, 2010.

Provides that all money in the St. Jude Children's Research Fund shall be used for grants to St. Jude Children's Research Hospital for pediatric treatment and research.

HB 3980: AUDITOR GEN-PERFORMANCE FINES (Assigned 1/27/2010)
Amends the Illinois State Auditing Act. Provides that if, in conducting a performance audit, which includes a program audit and a management or economy and efficiency audit, the Auditor General determines that an assessment of specified performance factors indicates a significant deficiency in program performance, the Auditor General, with the concurrence of the Joint Committee on Administrative Rules, may impose and collect an administrative fine upon each officer and employee responsible for that deficiency. Further provides that a fine may not exceed $50,000 per individual per program found to be deficient; that the Auditor General shall follow the provisions of Article 10 (Administrative Hearings) of the Illinois Administrative Procedure Act to the extent applicable; and that any fine so imposed is a personal liability of the officer or employee and shall not be reimbursed by the State or any other governmental entity.

HB 4667: VEH CD-WOMEN VET LIC PLATES (Assigned 1/27/2010)
Amends the Illinois Vehicle Code. Provides for issuance of Women Veteran license plates, at an additional initial charge of $15 with eligibility requirements to be determined by the Secretary of State. Provides that the $15 additional initial charge shall be deposited into the Secretary of State Special License Plate Fund. Effective immediately.

HB 4795: LIQUOR CONTROL-INVESTIGATORS (Assigned 1/27/2010)
Amends the Liquor Control Act. Supersedes Executive Order No. 2003-9 with respect to (1) the transfer of certain employees and resources from the State Liquor Control Commission to the Department of Revenue, and (2) the appointment of the Secretary and Executive Director of the State Commission by the Governor. Beginning July 1, 2010, moves the affected employees and positions back to the State Commission. Provides that the status and rights of the transferred employees shall remain unchanged by the transfer. Also transfers related resources, property, rules, and unexpended appropriations and balances back to the State Commission. Provides that the Secretary and Executive Director of the State Commission shall again be appointed by the State Commission rather than the Governor; except that the Secretary and Executive Director serving on June 30, 2010 may continue to serve for the remainder of their appointed terms. Includes savings provisions. Provides that the State Commission has the power to appoint investigators. Provides that these investigators have all the powers of peace officers solely for the purpose of enforcing the Act, and may carry firearms if certain conditions are met. Provides that a mayor, a president of a village board of trustees, or a president of a county board may have a direct interest in the manufacture, sale, or distribution of alcoholic liquor, provided that he or she is not involved in law enforcement, abstains from hearings and actions involving alcoholic liquor, and delegates any authority over the manufacture, sale, or distribution of alcoholic liquor to another official in the jurisdiction. Makes other changes. Effective immediately.

HB 4650: PRISONER CENSUS ADDRESSES (Assigned 1/27/2010)
Creates the Prisoner Census Adjustment Act. For purposes of creating election districts and redistricting, requires that State and local governmental bodies use census figures adjusted to reflect the pre-incarceration addresses of persons imprisoned in State or federal facilities in Illinois. Requires the Secretary of State to make the adjustments based upon information reported by State and local governmental entities that operate or place persons in facilities. Imposes the requirements beginning after the next federal decennial census.

SB 150: PUB HEALTH-COMM HEALTH CTR (Assigned 10/21/2009)
Creates the Community Health Center Construction Act. Provides that the Capital Development Board, in consultation with the Department of Public Health, shall establish the Community Health Center Construction Grant Program and may make grants to eligible community providers subject to appropriations. Provides that the grants shall be for the purpose of constructing or renovating new community health center sites, renovating existing community health center sites, and purchasing equipment to provide primary health care services to certain populations or areas. Contains provisions concerning grants, eligibility for grants, use of grant moneys, and reporting. Effective immediately.

SB 267: CONDO-DISTRESSED PROPERTY (Assigned 10/8/2009)
Amends the Condominium Property Act. Provides legislative findings concerning the importance of municipalities reclaiming housing stock that was used in fraudulent schemes. Provides procedures for addressing distressed condominium property that is a danger, blight, or nuisance to the surrounding community or the public and that is substantially unoccupied, without utilities, or in a serious negative condition. Provides definitions of "distressed condominium property", "owner", and "other party in interest". Provides that a municipality may file a petition in the circuit court and that if the court finds that a property is a distressed condominium property, the court may appoint a receiver to manage the property. Provides also that if a court finds that the property is not viable as a condominium, the court may deem that the entire property is owned in common by the unit owners and may authorize the receiver to sell the entire property without the consent of the unit owners. Provides that if the receiver sells the property pursuant to court authorization, the sale proceeds shall be paid to unit owners according to their respective shares, after sale expenses, taxes, and liens have been paid. Provides that the receiver has the power and authority to secure and insure the premises, make repairs, and otherwise manage the premises. Provides that other parties in interest shall be provided written notice and a copy of the petition or complaint either by United States certified mail, return receipt requested, within 30 days of the issuance of the summons or by personal service of the complaint. Provides that the court may authorize a receiver to enter into a sales contract for the property upon a motion, with notice to all owners and other parties in interest and those parties having an opportunity to be heard. Makes other changes.

Requires all members of the General Assembly to take X furlough days in the fiscal year beginning July 1, 2009. Provides that if salary or compensation is provided by law as set by the Compensation Review Board, then that means the salary or compensation in effect on the effective date of the amendatory Act and the future cost of living adjustments. Repeals all other provisions of the Act except the prohibition of the FY03 COLA. Amends the Civil Administrative Code of Illinois and various other Acts to provide that the compensation of certain officials of executive branch agencies is as set by the Compensation Review Board (instead of as set by the Governor or by the Compensation Review Board, whichever is higher). Effective immediately.

Sets forth criteria for approving out-of-State projects. Provides that the Authority shall not provide financing for any project, or portion of a project, located outside of the United States. Provides that the Authority shall not provide financing that constitutes an indebtedness of the State for any project, or portion of a project, located outside of the State. Provides that the Illinois Finance Authority may approve an application to finance or refinance a project located outside of the State only if the Authority has the ability to issue at least another $1,000,000,000 of bonds after giving effect to the financing or refinancing or the out-of-state project. Proposes that the Authority shall not provide financing that uses State volume cap under Section 146 of the Internal Revenue Code of 1986 for a project located outside of the State. Effective immediately.

Defines a qualified disabled veteran as a business entity 51% or more owned by one or more disabled veterans. Sets as a goal that each fiscal year the State award at least 3% of the value of its total contracts to qualified disabled veterans. Requires that the Department of Central Management Services report annually to the General Assembly on the attainment of the percentage goal, based on information reported by chief procurement officers. Requires chief procurement officers to make recommendations on the percentage goal, with input from statewide veterans' service organizations and the business community. Requires the Governor to recommend to the General Assembly changes in programs to assist qualified disabled veterans.

Provides that a municipality shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act for use by the municipality have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Limits home rule powers. Amends the School Code. Provides that a school board shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act that are used for the practice driving part of a driver education course offered by the school district have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Provides for the waiver of the Vehicle Identification Number requirements imposed under this Section. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

SB 1592: ETHICS-ECONOMIC INTERESTS (Assigned 4/14/2009)
Amends the Illinois Governmental Ethics Act. Permits the Secretary of State and county clerks to waive fees and penalties when a person files a statement of economic interests late, or fails to file the statement, due to his or her serious or catastrophic illness or military service. SB 1512: SOS-CONFIDENTIAL-ID-PLATES (Assigned 4/14/2009)
Amends the Illinois Identification Card Act and the Illinois Vehicle Code to provide procedures for the issuance and cancellation of confidential State identification cards, drivers' licenses, and license plates and registrations to local, state, and federal government agencies for bona fide law enforcement purposes. Provides that those confidential materials may be issued with fictitious names and addresses, and may be used only for confidential, investigative, or undercover law enforcement operations. Provides that the Secretary of State Police Department may cancel or refuse to renew those confidential materials when they have reasonable cause to believe they are being used for purposes other than those set forth in the application form or authorized by this Act. Effective immediately.

SB 1737: PROCUREMENT ST USE COMMITTEE (Assigned 4/14/2009)
Amends the Illinois Procurement Code. Makes the following changes with respect to the contract preference for sheltered workshops: changes references from handicapped persons to persons with disabilities; names the advisory committee the State Use Committee and adds members; requires the Governor to fill Committee vacancies within 30 days after notice of a vacancy; requires the Committee to develop a 5-year plan for increased State procurements from not-for-profit agencies serving persons with disabilities; and requires chief procurement officers, in consultation with the Committee, to determine which items are available from those not-for-profit agencies and to give priority to those agencies when making procurements. Effective immediately.

SB 1472: FINANCE--INTEREST PAYMENTS (Assigned 4/14/2009)
Amends the State Prompt Payment Act. Removes a provision that requires vendors to initiate a written request for the payment of an interest penalty that is at least $5 but less than $50. Removes a provision that authorizes the Department of Central Management Services and the State Comptroller to adopt rules establishing when interest penalties of less than $5 may be claimed and paid. Effective July 1, 2009.

SB 1333: MILITARY LEAVE OF ABSENCE (Assigned 4/14/2009)
Amends the Military Leave of Absence Act. Requires that a full-time employee of the State, a unit of local government, or a school district who is a member of a reserve component of the U.S. Armed Forces or the Illinois State Militia must be given a leave of absence for any training or duty required by the U.S. Armed Forces not otherwise covered by the Act. If the employee's military pay for that training or duty is less than his or her compensation from the public employer, requires that during the leave the employee receive his or her public employment compensation, minus the amount of the military pay.

SB 1342: INTERMODAL FACILITIES PROMO (Assigned 4/14/2009)
Creates the Intermodal Facilities Promotion Act. Provides that the incremental income tax attributable to a new employee of an individual, partnership, corporation, or other entity that owns and operates an intermodal terminal facility in the City of Joliet shall be deposited into the Intermodal Facilities Promotion Fund. Provides that moneys in the Fund shall be used by the Department of Commerce and Economic Opportunity to make grants to the eligible developer for infrastructure improvements. Sets limits on the grants. Amends the State Finance Act to create the fund as a special fund. Effective immediately.

Makes changes in provisions concerning the purposes of the Act; definitions; ex parte communication; construction, modification, or establishment of health care facilities or acquisition of major medical equipment; application for permits or exemption from application; powers and duties of the State Board and its staff; revision of criteria, standards, and rules; penalties; and an audit by the Auditor General. Adds provisions concerning Safety Net Impact Statements and creating the Nomination Panel, which provides a list of candidates to the Governor for appointment to Illinois Health Facilities and Services Review Board, the position of Chairman of the Board, and the Comprehensive Health Planner. Extends the repeal of the Act from July 1, 2009 to December 31, 2019. Repeals provisions concerning areawide health planning organizations, certificates of recognition, and the Task Force on Health Planning Reform. Makes related changes in other Acts. Effective immediately.

Amends the Illinois Workforce Investment Board Act. HB 4082: VEH CD-MOVING VIOLATIONS-FINES (Assigned 3/4/2009)
Amends the Illinois Vehicle Code and State Finance Act. Creates the Persons with Disabilities Fund as a special fund in the State treasury. Provides that a person who commits an offense against traffic regulations governing the movement of vehicles, in addition to any other penalty imposed by the court, shall pay a $15 surcharge to be deposited in the Persons with Disabilities Fund. Provides that all money in the Persons with Disabilities Fund shall be paid, subject to appropriation by the General Assembly and approval by the Secretary, to the Department of Central Management Services to provide services for persons with disabilities.

HB 4085: VEH CD-EMS LICENSE PLATES (Assigned 3/4/2009)
Amends the Illinois Vehicle Code. Provides for the issuance of Emergency Medical Services license plates to licensed Emergency Medical Technicians. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and at renewal. Provides that $15 of the additional original issuance fee and $23 the renewal fee shall be deposited into the EMS Assistance Fund. Provides that $10 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Effective immediately.

Amends the Secretary of State Act to give the Secretary of State Inspector General the authority to investigate lobbyist wrongdoing. Amends the Legislative Commission Reorganization Act of 1984. Creates the General Accounting Office as a legislative support services agency. Provides that the Office shall conduct a thorough review of each State executive branch program with respect to its relevance, efficiency, and effectiveness in obtaining the results required by, or achieving the goals expressed in, the statutes relating to the program. At least annually and also whenever appropriate or required by the circumstances, requires the Office to submit written reports to the General Assembly describing the Office's review of those programs and recommending, without limitation, elimination of any programs that are obsolete or not relevant, efficient, or effective; consolidation of duplicative programs; and steps to improve a program's relevance, efficiency, and effectiveness. Requires the Auditor General and all State agencies to cooperate with and provide requested information to the Office so that the Office can perform its functions and duties.

HB 4103: PROCUREMENT-LEASE RENEWALS (Assigned 3/4/2009)
Amends the Illinois Procurement Code. Requires that the conditions of a State lease renewal must be agreed upon within 30 days after lease expiration. Requires that a State agency report a holdover lease to the Procurement Policy Board. Requires that a lessor's failure to negotiate a lease renewal in good faith must be documented and may be considered in the future award of State leases.

Creates the Local Official's Sign Act. Makes it a Class A misdemeanor for the proper name of an elected officer of a unit of local government or school district to appear on a sign paid for with public funds. Amends the State Officials and Employees Ethics Act. Adds any type of sign to the prohibition against the proper name or image of an executive branch constitutional officer or General Assembly member from appearing on a commercial billboard designed, prepared, paid for, or distributed using public dollars.

Provides that the Secretary of State shall determine by rule what forms of proof of a person's status as a service member are acceptable, and the design of the distinct identification card is in the Secretary of State's discretion. Defines "service member" to mean a member of the armed services or reserve forces of the United States or a member of the Illinois National Guard. Effective January 1, 2010.

HB 4201: VEH CD-ARMED FORCES-UNDER 21 (Assigned 3/4/2009)
Amends the Illinois Vehicle Code. Defines "active duty" in the Illinois Vehicle Code as active duty pursuant to an executive order of the President of the United States, an act of the Congress of the United States, or an order of the Governor. Defines "service member" as a member of the armed services or reserve forces of the United States or a member of the Illinois National Guard. Provides that the Secretary of State's discretionary authority to suspend a person's driving privileges who is under the age of 21 and has had 2 moving violations in a period of 24 months does not apply to service members on active duty. Provides that the Secretary of State shall rescind the any such suspension occurring before the effective date of this Act. Effective immediately.

HB 4205: SERVICEMEMBER EMPLOY-VIOLATION (Assigned 3/4/2009)
Amends the Service Member's Employment Tenure Act. Provides that the Attorney General shall establish and maintain a statewide toll-free hotline to provide information and referrals to employees or other individuals concerning their rights under the Act; the hotline shall include the capability of accepting complaints of an employer's violation of the Act. Provides that the Attorney General shall establish and maintain a statewide list of employers who have been convicted of violating the Act; the Attorney General shall make the information in the list available to the public on its official web site and by any other means the Attorney General deems appropriate. Effective immediately.

HB 4206: DCEO-VETS-SMALL BUSINESS LOAN (Assigned 3/4/2009)
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Authorizes the Department of Commerce and Economic Opportunity to make participation loans to small businesses that are at least 51% owned and managed by one or more persons who are veterans for the purposes of promoting the creation of veteran-owned small businesses and promoting the creation of jobs within small businesses. Provides that a loan may not exceed $100,000 or 50% of the business project costs. Provides that a loan may be made only if, in the Department's judgment, the number of jobs to be created is reasonable in relation to the loan funds requested. Provides that a loan must be protected by security. Effective immediately.

HB 4208: PROC CD-VETERAN PREFERENCE (Assigned 3/4/2009)
Amends the Illinois Procurement Code. Requires that each chief procurement officer establish a goal of at least 10% of the total dollar amount of State contracts of agencies under the officer's jurisdiction to be awarded to veteran-owned businesses.

HB 4214: DPT VET AFF-VET HOME ADMISSION (Assigned 3/4/2009)
Amends the Department of Veterans Affairs Act. Provides that if a veteran has applied for admission to an Illinois Veterans Home and has been found to be entitled to admission but has been placed on a waiting list to be admitted because of a lack of room at a Home, the veteran may instead be admitted to a private facility licensed under the Nursing Home Care Act. Provides that the veteran is responsible for paying for his or her care at the facility at a daily rate based on the maximum maintenance charge that the veteran would have been required to pay at an Illinois Veterans Home; if that rate is less than the facility's charge for the veteran's care as negotiated with the departments of Veterans' Affairs and Healthcare and Family Services, the Department of Veterans' Affairs shall pay the difference between those amounts to the facility. Provides that the Department of Veterans' Affairs, in cooperation with the Department of Healthcare and Family Services, shall develop a list of long-term care facilities willing to admit veterans under these provisions. Provides that a veteran admitted to a private long-term care facility under these provisions shall be transferred to an Illinois Veterans Home as soon as a bed is available for the veteran in a Home for which he or she is qualified. Effective immediately.

HB 4238: VETERAN IDENTIFICATION (Assigned 3/4/2009)
Amends the Illinois Vehicle Code and Illinois Identification Card Act to provide that the Secretary of State shall designate on each identification card (driver's license or Illinois identification card) issued a space where the word "veteran", on a distinct background, would be placed at the request of an applicant for an identification card who also presents to the Secretary of State a written confirmation from the Department of Veteran's Affairs that the applicant is a veteran of the United States Armed Forces and was not dishonorably discharged. Provides that the Secretary of State may disclose the applicant's social security number or any associated information obtained from the Social Security Administration without the written request or consent of the individual to the Department of Veterans' Affairs for the purpose of confirming veteran status for qualification for distinct identification cards or veteran special license plates. Effective January 1, 2010.

HB 4243: FIREARM OWNERS ID-DATABASE (Assigned 3/4/2009)
Amends the Firearm Owners Identification Card Act. Provides that the information contained in the record of transfer of firearms, stun guns, and tasers shall be forwarded to the Department of State Police, which shall create a database containing all such information in the record. Provides that the failure to forward the information contained in the record to the Department of State Police within 10 days after the transfer of the firearm, stun gun, or taser is a petty offense. Effective January 1, 2010.

HB 4254: OIL COMPANY INCENTIVES (Assigned 3/4/2009)
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that neither the Department of Commerce and Economic Opportunity nor the Department of Revenue shall award any discretionary tax or other incentive to any entity whose primary business is the production of oil or gas.

Provides that a person who has been elected to any office in this State who is convicted of a felony or convicted of a misdemeanor involving a violation of his or her official oath of office shall, as a condition of his or her sentence, forfeit any monetary rights derived from any book, movie, television, radio program, or Internet depiction or detailing of the crime for which he or she was convicted. Provides that the order shall extend to the period in which the elected official is serving a sentence in a penal institution and any period of probation, parole, or mandatory supervised release.

Amends the Open Meetings Act, the Freedom of Information Act, and the Attorney General Act. Requires each public body to have a freedom of information officer to process requests for inspection and copying of public records. Establishes within the Attorney General's Office an Office of the Public Access Counselor, and requires the Attorney General to appoint the Counselor. Authorizes the Counselor to issue binding opinions on a public body's compliance with the Open Meetings Act or on a public body's denial of access to public records, when requested by the denied party. Provides for administrative review of Public Access Counselor's opinions.

Creates the Blind Vendors Act. Creates the Business Enterprise Program for the Blind and provides that the Secretary of Human Services, through the Bureau Director of the Bureau for the Blind in the Department of Human Services, shall continue, maintain, and promote the Program. Provides that the Program must provide that: priority is given to blind vendors in the operation of vending facilities on State property; tie bid preference is given to blind vendors in the operation of cafeterias on State property unless the cafeteria operations are operated by employees of a State agency; vending machine income from all vending machines on State property is assigned as provided in the Act; no State agency may impose a commission, service charge, rent, or utility charge on a licensed blind vendor who is operating a vending facility on State property; and vending facilities operated by the Program use reasonable and necessary means and methods to maintain fair market pricing in relation to each facility's given demographic, geographic, and other circumstances. Contains provisions concerning: intent; compliance with federal law; rules; establishment of vending facilities on State property; other vending facilities; creation of a Blind Vendors Trust Fund as a separate account managed by the Department of Human Services for the State's blind vendors; set-aside funds; vending machine income; issuance of licenses; creation of a Committee of Blind Vendors to participate in the development and implementation of all policies, plans, program development, and major administrative and management decisions affecting the Program; hearings; arbitration; reports and surveys; and other matters. Repeals the Blind Persons Operating Vending Facilities Act.

Amends the Military Code of Illinois and the Department of Veterans Affairs Act. Creates the Division of Family Affairs within the Department of Military Affairs to assist family members of military members who are mobilized or in service abroad, including through advocacy to help such family members access all available State services that are provided through the Department or any other State agency. Makes the head of the Division an Assistant Adjutant General. Creates the Division of Women Veterans Affairs within the Department of Veterans' Affairs to serve as an advocate for women veterans and assess the needs of women veterans with respect to issues including, but not limited to, compensation, rehabilitation, outreach, health care, and issues facing women veterans in the community; also provides that the Division shall review the Department's programs, activities, research projects, and other initiatives designed to meet the needs of women veterans and shall make recommendations to the Director of Veterans' Affairs concerning ways to improve, modify, and effect change in programs and services for women veterans. Makes the head of the Division an Assistant Director of Veterans' Affairs. Effective immediately.

Amends the Illinois Procurement Code. Requires that State agencies procure environmentally preferable supplies and services, with certain exceptions. Requires the State Treasurer to implement and administer, by rule, a program requiring financial institutions to make mortgage loans on residential property in order for that financial institution to be eligible for investment of State funds in that financial institution. Requires the rules to contain provisions concerning not rejecting residential mortgage loans because of the location of the property, minimum assets to be invested in residential mortgage loans, minimum annual new residential mortgage loans, and reporting and auditing. Requires the Treasurer to report annually to the General Assembly. Effective immediately.

HB 3687: IL SERV EDUCATION AWARD GRANT (Assigned 3/3/2009)
Amends the Illinois Commission on Volunteerism and Community Service Act and the State Finance Act. Subject to appropriation from the Illinois Service Education Award Grant Fund, a special fund created in the State treasury, allows the Commission on Volunteerism and Community Service to award an Illinois Service Education Award Grant to recipients of a national service educational award awarded by the Corporation for National Community Service, which grant must be awarded only as a partial matching grant. Provides that an individual who successfully completes a required term of full-time national service in an approved national service position in this State may apply to receive a grant. Sets forth the purposes for which a grant may be used.

Amends the Community Service Education Act. Provides that the Community Service Education Program must be jointly administered by the State Board of Education and the Office of the Lieutenant Governor (instead of being administered solely by the State Board). Provides that the State Board and the Office of the Lieutenant Governor are jointly authorized to make grants (instead of only the State Board being authorized). Requires the State Board and the Office of the Lieutenant Governor to jointly adopt rules (instead of allowing the State Board to adopt rules).

HB 3916: DATA SECURITY ON ST COMPUTERS (Assigned 3/3/2009)
Amends the Data Security on State Computers Act. Provides that the definition of "Agency" does not include public universities or their governing boards. Provides that the Act does not apply to the legislative branch of State government, the Office of the Lieutenant Governor, the Office of the Attorney General, the Office of the Secretary of State, the Office of the State Comptroller, or the Office of the State Treasurer. Requires the governing board of each public university in this State to implement and administer the provisions of the Act with respect to State-owned electronic data processing equipment utilized by the university. Provides that the governing board shall implement a policy to mandate that all hard drives of surplus electronic data processing equipment be cleared of all data and software before being prepared for sale, donation, or transfer by following certain requirements. For purposes of the Act and any other State directive requiring the clearing of data and software from State-owned electronic data processing equipment prior to sale, donation, or transfer by a public university, provides that the governing board of the university shall have and maintain responsibility for the implementation and administration of the requirements for clearing State-owned electronic data processing equipment utilized by the university. Effective immediately.

HB 3919: GOVT JOINT PURCHASING-CMS (Assigned 3/3/2009)
Amends the Governmental Joint Purchasing Act. Authorizes the State, through the Department of Central Management Services, to purchase personal property, supplies, and services jointly with a governmental entity of another state or with a consortium of governmental entities of one or more other states. January 1, 2010.

HB 4012: DEVELOPMENT ASSISTANCE-NOTIFY (Assigned 3/3/2009)
Amends the Corporate Accountability for Tax Expenditures Act. Provides that each recipient of development assistance shall file an annual consolidated progress report (instead of a progress report for each development assistance agreement). Provides that the progress report may include other information the Department deems necessary to ensure compliance with a development assistance program. Amends the Build Illinois Bond Act. Provides that businesses that receive certain grants or loans must notify the Department if the business fails to meet the agreed employment or investment conditions of the grant or loan.

HB 4031: IEMA SHARED ADMIN FUNCTIONS (Assigned 3/3/2009)
Amends the Illinois Emergency Management Agency Act. Authorizes the Agency to perform the "common administrative functions" that were transferred from the Agency to the Department of Corrections by Executive Order Number 6 of 2006. Provides for transfer of the related property, records, contracts, unexpended appropriations, and pending business back to the Agency. Effective immediately.

HB 3653: PUB HLTH-HIV/AIDS RSPNS TEAM (Assigned 3/3/2009)
Amends the African-American HIV/AIDS Response Act. Provides that the administration of the Act is transferred to the Department of Human Services. Provides that the Response Officers of certain Departments shall collectively form the Interagency HIV/AIDS Prevention Team (IIHAPT). Provides that the IIHAPT must establish its own guidelines for operation. Sets for the responsibilities of the IIHAPT. Provides that the Department must partner with the Administrative Support Agency (ASA) to coordinate the response to HIV/AIDS in the African American Community. Sets forth duties of the ASA. Provides that the HIV/AIDS Response Review Panel must work with the ASA and IIHAPT to create and implement a comprehensive State-wide plan to reduce the HIV infection rate within the African American Community. Provides that the African-American HIV/AIDS Response Fund shall become a line item in the State's annual budget. Provides that the amount of $10,000,000 shall be deposited into the Fund at the beginning of each fiscal year and that this amount shall be reduced each year equal to the amount that is raised from other sources each year of the Fund's existence. Sets forth expenditures for the Fund. Makes other changes.

HB 3722: PENSION ETHICS (Assigned 3/3/2009)
Amends the Illinois Governmental Ethics Act. Requires members of the board of any pension fund or retirement system established under the Illinois Pension Code to file a statement of economic interests. Amends the State Officials and Employees Ethics Act. Includes appointed or elected commissioners, trustees, directors, or board members of a board of a State agency, including the boards found in the Illinois Pension Code, in the definition of "employee". Amends the Illinois Pension Code. Makes changes in provisions concerning the definition of "fiduciary", allocation and delegation of fiduciary duties, and prohibited transactions. Adds provisions concerning investment advisers, consultants, and investment services for investment boards, pension funds, and retirement systems other than downstate police and fire pension funds; investment transparency; prohibitions on monetary gain on investments; fraud; prohibitions on gifts; contingent fees; and procurements for pension funds, retirement systems, and investment boards, except downstate police and fire pension funds. Requires the University of Illinois to create the Illinois Fiduciary College for the purpose of education pension fund, retirement system, and investment board members and staffs on ethics.

HB 3802: LOBBYIST ETHICS TRAINING (Assigned 3/3/2009)
Amends the State Officials and Employees Ethics Act and the Lobbyist Registration Act. Requires that each person required to register under the Lobbyist Registration Act, and that person's employees, annually must complete ethics training provided by the Secretary of State. Permits the Secretary to adapt ethics training required for State employees.

HB 3815: GREEN BUILDINGS ACT (Assigned 3/3/2009)
Creates the Green Buildings Act. Requires that State-funded building construction and major renovations of existing State-owned facilities must meet certain energy and environmental standards of the Leadership in Energy and Environmental Design program rating system, the Green Building Initiative's Green Globes rating system, or an equivalent rating system. Permits waiver of the standards by the Capital Development Board or another agency. Specifies the criteria for waivers. Requires the Board to analyze and evaluate the Act's green building standards after the earlier of 5 years or the completion of 10 Board green projects. Effective immediately.

HB 4027: SURPLUS STATE REAL PROPERTY (Assigned 3/3/2009)
Amends the State Property Control Act concerning surplus real property. Requires utilization reports to be submitted by July 31 (instead of October 30), declarations of surplus real property to be made by October 31, (instead of December 31), and notification of State agencies by October 31 (instead of December 31).

HB 3691: COURT ALTERNATIVE DISPUTE FUND (Assigned 3/3/2009)
Amends the State Finance Act, Appellate Court Act, and Reviewing Court Alternative Dispute Resolution Act. Eliminates the Reviewing Court Alternative Dispute Resolution Fund. Provides that any balance in the Fund shall be transferred into the Mandatory Arbitration Fund.

Amends the Illinois Violence Prevention Act of 1995. Provides that the Illinois Violence Prevention Authority has the responsibility to distribute grants, pursuant to rules adopted by the Authority and subject to available appropriations and other funds received for purposes of the Act, to community or statewide organizations that address violence prevention in a comprehensive and collaborative manner (rather than to distribute such grants without rules adopted by the Authority). Amends the Deposit of State Moneys Act. Provides that the State Treasurer may, with the approval of the Governor, invest State money in short-term obligations of corporations organized in the United States with assets exceeding $500,000,000 if, among other things, the obligations mature not later than 270 (instead of 180) days after the date of purchase. Amends the Nurse Practice Act. Ratifies and adopts the Nurse Licensure Compact. Allows for reciprocity of licensure of licensed practical nurses and registered nurses among the states. Provides for administration of the Compact by the Nursing Act Coordinator. Provides that the licensing board shall participate in a Compact Evaluation Initiative designed to evaluate the effectiveness and operability of the Compact. Provides that the Compact does not relieve employers from complying with statutorily imposed obligations. Provides that the Compact does not supersede existing State labor laws. Makes changes relating to the purposes of the Compact. Effective January 1, 2010.

HB 2623: OPEN MEETING-OTHER PUBLIC BODY (Assigned 2/25/2009)
Amends the Open Meetings Act. Provides that the Act is not violated when, without notice or minutes, a majority of the quorum of one public body attends and discusses public business at a meeting of another public body that complies with the Act's notice and minutes requirements. Effective immediately.

HB 2645: POLICE TRAINING-MUNI POLICE (Assigned 2/25/2009)
Amends the Illinois Police Training Act. Provides that, if a person (i) attends training at the Law Enforcement Training Standards Board equivalent to training offered to persons being trained to serve on a municipal police force, (ii) serves as a police officer for an Illinois forest preserve district, and (iii) transfers to an Illinois municipal police force, then the person shall qualify to serve as a municipal police officer on the same basis as a trained municipal police officer. Effective immediately.

HB 2505: OVARIAN CANCER AWARENESS MO (Assigned 2/25/2009)
Amends the State Commemorative Dates Act. Designates the month of September of each year as Ovarian and Prostate Cancer Awareness Month.

HB 2494: LT GOVERNOR VACANCY ACT (Assigned 2/25/2009)
Creates the Lieutenant Governor Vacancy Act. Provides that the Governor shall assume and exercise the powers and duties of the Lieutenant Governor while the position of Lieutenant Governor is vacant. Authorizes the Governor to delegate any of those powers to an appropriate State employee, officer, or agency. Authorizes expenditure of appropriations. Authorizes the Governor to either suspend or continue the Office of the Lieutenant Governor. Includes provisions relating to contracts and employment. Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois and the Gifts and Grants to Government Act to delete obsolete language relating to a previous vacancy. Effective immediately.

HB 2535: VEH CD-BIODIESEL FUEL USE (Assigned 2/25/2009)
Amends the Illinois Vehicle Code. Increases the percentage of biodiesel blend required to be used by a diesel powered vehicle owned by the State or units of local government of the State when refueling at a bulk central fueling facility from 2% to 5%, unless the engine is designed to operate on a higher percentage. Effective July 1, 2009.

HB 2593: DATES-CHILDREN'S DAY (Assigned 2/25/2009)
Amends the State Commemorative Dates Act. Provides that the second Sunday in June each year is a holiday to be known as Children's Day (El Dia de los Ninos). Provides that Children's Day is to be observed throughout the State as a day to recognize and acknowledge the lives of all children.

HB 2574: CD CORR-DRUG&ALCOHOL TREAT (Assigned 2/25/2009)
Amends the Unified Code of Corrections. Provides that if the committed person has been convicted of a felony DUI offense or a felony violation of the Illinois Controlled Substances Act, a felony violation of the Methamphetamine Control and Community Protection Act, or a felony violation of the Cannabis Control Act, he or she shall be assigned to an alcoholism or drug treatment program approved by the Department of Human Services. Provides that the Department of Corrections may provide treatment to such persons in a separate institution within the Department, or the Director of the Department of Corrections may transfer such person to the Department of Human Services for treatment for a period of not more than 6 months, if the person consents in writing to the transfer. Provides that the person shall be advised of his or her right not to consent, and if he or she does not consent, such transfer may be effected only by a court commitment order. Provides that the committed person shall pay the Department that provides the treatment $100 for that treatment. Effective January 1, 2010.

HB 2644: PEACE OFFICERS MEMORIAL DAY (Assigned 2/25/2009)
Amends the State Commemorative Dates Act. Designates the first Thursday in May of each year as Peace Officers Memorial Day and the week including that day as Police Week. Recognizes each May 15th as National Peace Officers Memorial Day.

HB 2651: CRIM CD-PUBLIC CONTRACTOR (Assigned 2/25/2009)
Amends the Criminal Code of 1961. Provides that a public contractor, employee of a public contractor, or a person seeking a public contract also commits the offense of public contractor misconduct when he or she knowingly or intentionally seeks or receives compensation or reimbursement for goods and services he or she purported to deliver or render, but failed to do so pursuant to the terms of the contract, to the unit of State or local government or school district. Provides that any person convicted of the offense or a similar offense in any state of the United States which contains the same elements of public contractor misconduct shall be barred for 10 years from the date of conviction from contracting with, employment by, or holding public office with the State or any unit of local government or school district. Provides that the Attorney General or the State's Attorney in the county where the principal office of the unit of local government or school district is located may bring a civil action on behalf of any unit of State or local government to recover a civil penalty from any person who knowingly engages in conduct which violates the statute in treble the amount of the monetary cost to the unit of State or local government or school district involved in the violation. Effective immediately.

HB 2625: VEH CD-TEAMSTERS PLATES (Assigned 2/25/2009)
Amends the Illinois Vehicle Code and the State Finance Act. Creates the International Brotherhood of Teamsters Fund as a special fund in the State treasury. Provides for the issuance of International Brotherhood of Teamsters license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $40 at original issuance and $27 at renewal. Provides that $25 of the additional original issuance fee and the renewal fee shall be deposited into the International Brotherhood of Teamsters Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, the moneys in the International Brotherhood of Teamsters Fund shall be paid as grants to the Teamsters Joint Council 25 Charitable Trust, an independent organization established and registered as a tax exempt entity under Section 501(c)(3) of the Internal Revenue Code.

HB 2490: VEH CD-DUI-MONITORING DEVICE (Assigned 2/25/2009)
Amends the Illinois Vehicle Code. Defines "continuous alcohol monitoring device" as a device that automatically tests breath, blood, or transdermal alcohol concentration levels at least once every hour and detects tamper attempts, regardless of the location of the person who is being monitored, and regularly transmits such data. Provides that if a person is found guilty of driving while his or her driving privileges are suspended for a fourth, fifth, sixth, seventh, eighth, or ninth time and the license suspension was for a conviction of driving under the influence of alcohol or drugs or other prohibited substances or a summary suspension under the implied consent provisions of the Illinois Vehicle Code, that person is guilty of a Class 4 felony and must serve a minimum term of imprisonment of 180 days or serve a minimum of 60 days and abstain from consuming alcohol while wearing a continuous alcohol monitoring device to verify compliance for 270 days (rather than being guilty of a Class 4 felony and serving a minimum term of imprisonment of 180 days). Provides that for a tenth, eleventh, twelfth, thirteenth, or fourteenth violation of the same, after a term of imprisonment, the person shall abstain from consuming alcohol and wear a continuous alcohol monitoring device to verify compliance for 365 days.

HB 2272: PRIVATE MILITARY CONTRACTORS (Assigned 2/23/2009)
Creates the Limitations on Private Military Contractors Act. Requires training to be directly supervised by, and training personnel certified by, the Illinois State Law Enforcement Standards and Training Board or the Illinois State Police. Prohibits use as an armed force except under an emergency order of the Governor. Effective immediately.

HB 2317: OPEN MEETING-CONTEMPORANEOUS (Assigned 2/23/2009)
Amends the Open Meetings Act. Defines a "contemporaneous" meeting to exclude replies to electronic communications. Requires inclusion of such a reply in the record of an open meeting under certain circumstances.

HB 2430: COGFA-HEALTH PROCUREMENT (Assigned 2/23/2009)
Amends the Legislative Commission Reorganization Act of 1984. Authorizes the Commission on Government Forecasting and Accountability to enter into a contract to conduct a study of health care procurement by the State of Illinois under the Illinois Department of Healthcare and Family Services in relation to the Medicaid program, the State employees group insurance program, and other medical services for which it provides procurement services and to recommend methods for reducing these costs and obtaining the best value for these services. Effective immediately.

HB 2452: SCIENCE ADVISORY BOARD ACT (Assigned 2/23/2009)
Creates the Science Advisory Board Act. Creates the Science Advisory Board for the purpose of rendering scientific assessmens of, as well as risk-based analysis and consensus advice upon questions of science posed by the Governor or Legislative Committees having jurisdiction over scientific matters. Provides for appointments to the Board; terms of appointees; and the removal of appointees. Sets forth qualifications for Board members. Prohibits certain persons from participating in the work of the Board. Requires the Board to review and summarize pertinent scientific studies related to charged topics; to summarize findings and recommendations in a manner that is timely, objective, transparent, and understandable by elected officials and policymakers; to achieve consensus in its decision making, if possible, and to provide for reports of minority opinions, if consensus is not possible. Sets out other requirements for Board action. Provides that the Director of the Legislative Research Unit shall act as the Executive Director of the Board and shall assign such clerical and staff support from the Legislative Research Unit staff as is required. Requires members of the Board to be reimbursed from appropriations made by the General Assembly for reasonable expenses incurred as a result of their services.

HB 2466: PUBL SAFETY OFFICER-REIMBURSE (Assigned 2/23/2009)
Creates the Public Safety Officer Protection Act. Provides that a public employer shall reimburse a public safety officer for reasonable attorney's fees incurred by the officer in connection with any criminal proceeding arising from the officer's conduct in the performance of official duties unless, in relation to that conduct, any of the following applies: (1) the officer is convicted of a crime; (2) the officer's employment is terminated for cause; or (3) the officer resigns for reasons other than retirement or disability before the attorney's fees are incurred. Provides that a public employer, including a home rule unit, that employs a full-time public safety officer may not provide benefits to that officer in a manner inconsistent with the requirements of the Act.

HB 2235: EDUC-ADMIN TEACHR SALARY BENFT (Assigned 2/23/2009)
Amends the School Code and various Acts relating to the governance of public universities and community colleges in Illinois. Requires the governing board of each school district, university, and community college to report to the State Board of Education or Board of Higher Education, on or before July 1 of each year, the base salary and benefits of all administrators and teachers or faculty employed by the school district, university, or community college district.

HB 2248: HUMAN RTS-EMPLOYER REPORT FORM (Assigned 2/23/2009)
Amends the State Finance Act. Creates the Department of Human Rights Special Fund. Provides that moneys in the Department of Human Rights Special Fund are not subject to transfer to the General Revenue Fund. Amends the Illinois Human Rights Act to provide that the registration fee for filing an Employer Report Form is $75, and that the Department of Human Rights Special Fund is not subject to sweeps, administrative charges or charge-backs, or any other fiscal or budgetary maneuver that would in any way transfer any funds from the Fund into any other fund of the State. Effective January 1, 2010.

HB 2284: IL COMMERCE COMMSSN-WAREHOUSES (Assigned 2/23/2009)
Amends the Personal Property Storage Act. Provides for administration of the Act by the Illinois Commerce Commission (instead of the Department of Agriculture). Makes changes concerning applications by limited liability companies, bond or insurance amounts, violation of the Commission's rules, fees set by rule, investigators, civil penalties, license revocation, subpoenas, and oaths. Effective January 1, 2010.

HB 2302: HUMAN RTS-TRAINING TUITION (Assigned 2/23/2009)
Amends the Illinois Human Rights Act and the State Finance Act. Authorizes the Department to charge tuition for training it furnishes to non-governmental entities, other than not for profit groups with less than 50 employees or organizations in Illinois with 50 employees or less. Authorizes the Department to provide its training at no cost to not for profit groups or organizations that have no more than 50 employees, Department employees, other State agencies and instrumentalities, and community organizations. Provides that the Department will make training available to any other non-governmental entities on a tuition basis. Provides that tuition received shall be paid into the Department of Human Rights Training and Development Fund, a new special fund. Effective January 1, 2010.

HB 2377: LOCAL GOV-CONSTRUCTION BIDDERS (Assigned 2/23/2009)
Creates the Local Government Construction Contract Bidders Act. Requires bidders on construction contracts with units of local government and school districts to comply with applicable laws, comply with applicable provisions of the Prevailing Wage Act, comply with federal equal employment opportunities laws, have a valid FEIN or SSN, have valid insurance certificates, and participate in apprenticeship and training programs. Imposes monetary penalties for violation.

HB 2406: FOREST PRESERVE-CONTRACTS (Assigned 2/23/2009)
Amends the Downstate Forest Preserve District Act. Excepts the following types of contracts from competitive bidding requirements: professional or technical services, utilities, technology integration, printed matter, those not adapted to bidding, single source, repairs by the manufacturer or its agent, and emergency. Effective immediately.

HB 2433: VEH CD-EMS MEMORIAL PLATES (Assigned 2/23/2009)
Amends the Illinois Vehicle Code and State Finance Act. Creates the Illinois EMS Memorial Scholarship and Training Fund as a special fund in the State treasury. Provides for the issuance of Illinois EMS Memorial Scholarship and Training license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $27 at original issuance and $17 at renewal. Provides that $12 of the additional original issuance fee and $15 the renewal fee shall be deposited into the Illinois EMS Memorial Scholarship and Training Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, all money in the Illinois EMS Memorial Scholarship and Training Fund will be paid as grants to the EMS Memorial Scholarship and Training Council, a not-for profit corporation, for the purposes of providing scholarships for graduate study, undergraduate study, or both, to children and spouses of emergency medical services personnel killed in the course of their employment, and for grants for the training of EMS personnel. Effective immediately.

HB 1332: US FLAG DISPLY-STATE-LOCL GOVT (Assigned 2/23/2009)
Creates the Official United States Flag Act. Provides that each agency of the State government and each unit of local government shall ensure that each United States flag that is flown at each building, structure, or facility that is owned or occupied entirely by the agency or unit of local government is manufactured in the United States.

HB 1335: SCH CD-PRESS BOX-ACCESSIBILITY (Assigned 2/23/2009)
Amends the School Code. Provides that a school board does not have to comply with the Illinois Accessibility Code with respect to accessibility to press boxes that are 1,000 square feet or less and that are on school property.

HB 2400: PROMPT PAYMENT-MH/DD SERVICES (Assigned 2/23/2009)
Amends the State Prompt Payment Act. Includes within the definition of "goods or services", prevention, intervention, or treatment services and supports for persons with developmental disabilities, mental health services, alcohol and substance abuse services, rehabilitation services, and early intervention services provided by a vendor, which includes but is not limited to a licensed community-based provider but does not include a licensed hospital, a unit of local government, or a university. Effective immediately.

HB 1345: FOIA-SETTLEMENT AGREEMENTS (Assigned 2/23/2009)
Amends the Freedom of Information Act. Redefines a "public record" to include the portion of a settlement agreement entered into by or on behalf of a public body that shows the total amount of any moneys or total financial value of other agreements that resulted in a financial payment to or by the public body and the amount expended by or on behalf of the public body for the prosecution, defense, or settlement of any litigation. Effective immediately.

HB 2414: COMMUNITY SERVICES IMPACT NOTE (Assigned 2/23/2009)
Creates the Community Services Impact Note Act. Requires that an estimate of the fiscal impact upon the provision of community services to persons with developmental disabilities or mental illness be submitted by the sponsor of a bill in the General Assembly that (i) affects the provision of such services or (ii) amends one of several specified Acts. Provides for the preparation of the note by the Department of Human Services, the preparation of a note at the request of a legislator other than the sponsor, and the adjustment of a note in relation to amendment of the bill. Effective immediately.

HB 2376: STATE FACILITY CLOSURE (Assigned 2/23/2009)
Amends the State Facilities Closure Act. Provides that, if appropriations have been made for the current fiscal year for the operation of a State facility during the entire fiscal year, then no action may be taken to close the facility, to reduce its capacity to serve the number of residents, youth, or inmates for which the appropriation was made, or to move its location from the county in which the service is provided, unless the action is specifically approved by the same joint resolution of the General Assembly. Effective immediately.

HB 2465: LOC GOV EMPLOY POLITICAL RIGHT (Assigned 2/23/2009)
Amends the Local Governmental Employees Political Rights Act. Adds that a member of a police department or a sheriff's department may be elected or appointed to public office and may serve in public office. Provides that if the member is not in uniform and not on duty, the member may solicit votes and campaign funds and challenge voters. Adds that a police officer or sheriff's deputy who is elected to the Illinois General Assembly shall, upon written application to the employer, be granted a leave of absence without compensation during his or her term of office.

HB 2360: HOMEOWNER EMERGENCY ASSIST ACT (Assigned 2/23/2009)
Creates the Illinois Homeowner's Emergency Assistance Program Act. Contains provisions concerning the powers and duties of the Illinois Housing Development Authority with respect to the Act, the eligibility of a homeowner for assistance under the Act, the assistance payments for eligible homeowners, and funding for the program. Provides that the Act is repealed on January 1, 2011. Effective immediately.

HB 2369: PROC CD-LIMIT FOREIGN VENDORS (Assigned 2/23/2009)
Amends the Illinois Procurement Code. Provides that a purchasing agency, chief procurement officer, associate procurement officer, or State purchasing officer may not enter into an agreement (i) to purchase or lease goods on behalf of a State agency unless 100% of the goods to be purchased or leased under the agreement are made or assembled in the United States or (ii) to procure services on behalf of a State agency unless 100% of the services to be procured under the agreement are provided within the United States. Requires each vendor, bidder, contractor, or subcontractor who submits a bid or enters into a procurement agreement with a State agency to certify compliance with these requirements. Authorizes certain exemptions from these requirements. Requires the purchasing agency, chief procurement officer, associate procurement officer, or State purchasing officer to terminate agreements for noncompliance and to collect from the vendor, contractor, or subcontractor an amount equal to 25% of the value of the agreement as liquidated damages if, during the life of an agreement, the vendor, contractor, or subcontractor violates these requirements. Prohibits a contractor, subcontractor, vendor, or bidder that violates these requirements from receiving any State contracts for a period of 5 years after the violation. Authorizes a State agency to bring a civil action in State or federal court to compel enforcement of this Act. Permits courts to award reasonable attorney fees and costs to the State agency. Effective immediately.

Provides that the Director of the State Police may appoint, subject to the Personnel Code, persons to be members of the police and security force. Provides that members of the security force shall be peace officers. Effective immediately.

HB 905: CDB LOCAL BUILDING CODES (Assigned 2/18/2009)
Amends the Capital Development Board Act. Requires local governments without building codes to adopt building codes based on specified model codes. Requires that persons performing building inspection services under the Act must be qualified by the State, certified by a certification organization, or have filed verification of inspection experience with the Board. Permits a local government to out-source building inspection. Defines a local government as a municipality, county, or fire protection district. Exempts municipalities over 500,000 population, and applies beginning July 1, 2011, except that a local government must provide notice to the Board of its adopted building code within 60 days after the bill's effective date.

HB 911: GRADE CROSSING FUND-NO SWEEPS (Assigned 2/18/2009)
Amends the State Finance Act. Provides that the Grade Crossing Protection Fund is not subject to sweeps, administrative charges, or charge-backs or any other fiscal or budgetary maneuver that would in any way transfer any funds from the Grade Crossing Protection Fund into any other fund of the State unless specifically authorized by law. Effective immediately.

HB 1011: IHDA-HOME PROTECTION PILOT (Assigned 2/18/2009)
Creates the Home Protection Pilot Program Act. Requires the Illinois Housing Development Authority to implement a pilot program to assist Illinois workers who have lost jobs as a result of changing economic conditions in Illinois when those workers are in need of assistance to avoid losing their homes to foreclosure. Provides that the Program shall include counties selected at the discretion of the Authority on the basis of increased rates of foreclosure, actual foreclosure filings, unemployment, the need of local counseling agencies for increased capacity to serve clients in need of assistance to avoid losing their homes to foreclosure, the availability of funding, and other factors the Authority determines to be relevant. Provides for loans to homeowners secured by liens on residential real property located in Illinois, and prohibits a mortgagee from engaging in certain conduct upon a mortgagor's filing of an application for loan assistance. Sets forth other provisions of the Program. Requires the Authority to conduct a study and to report to the Governor and the General Assembly by May 1, 2010.

Creates the Illinois Energy Efficiency and Conservation Block Grant Act. Provides that the Green Governments Coordinating Council shall be the State governmental body responsible for applying for and distributing any and all energy efficiency and conservation grant money pursuant to the federal Energy Independence and Security Act of 2007. Sets forth the duties of the Green Governments Coordinating Council with respect to those grant moneys. Effective immediately.

Amends the Illinois Vehicle Code and the State Finance Act. Creates the Partnerships in Action Fund as a special fund in the State treasury. Provides for the issuance of Partnerships in Action license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged an original issuance fee of $40 and a fee of $27 for each renewal. Provides that $25 of the additional original issuance fee and $25 of the renewal fee shall be deposited into the Partnership in Action Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, all moneys in the Partnerships in Action Fund shall be paid to the Illinois Department of Human Services for the purpose of educational events and partnerships to reduce hunger, disease, illiteracy, and poverty.

HB 1093: STATE MILEAGE REIMBURSE RATE (Assigned 2/18/2009)
Amends the State Finance Act. Provides that for personnel under the jurisdiction of the State travel control boards, the allowance rate for automobile travel mileage reimbursement, which is the same as the rate set by federal regulations, shall be increased or decreased during the State's fiscal year as of the effective date of the federal regulations (now, increases do not take effect until the next July 1).

Amends the State Finance Act. Provides that certain payments for medical, pharmaceutical, and child care services may be paid out of appropriations for those purposes for a fiscal year if the services were rendered in that fiscal year (now, without regard to the fiscal year in which rendered). Amends the State Budget Law of the Civil Administrative Code of Illinois. Requires that the Governor's submitted budget include information concerning the amount and description of overdue bills and invoices under the State Prompt Payment Act. Amends the Prompt Payment Act. Accelerates the payment period from 60 days after the bill is submitted to 30 days after the bill is submitted. Increases the interest penalty from 1% to 1.5% if the payment is not made within 60 days after the bill is submitted. Effective immediately.

Amends the State Finance Act and the Property Tax Code. Extends provisions concerning tax recovery for taxing districts because of the lease of land for development of an airport in Will County for an additional 10 years (from December 31, 2010 to December 31, 2020). Effective immediately.

HB 986: DISABLED-CROHN'S/COLITIS (Assigned 2/18/2009)
Amends the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. In the definition of "disabled", adds Crohn's disease and ulcerative colitis to the list of conditions that may lead to a severe physical or mental disability and, thus, qualify under the definition. Effective immediately.

HB 1013: GREEN BUILDINGS ACT (Assigned 2/18/2009)
Creates the Green Buildings Act. Requires that State-funded building construction and major renovations of existing State-owned facilities must meet certain energy and environmental standards of the Leadership in Energy and Environmental Design program rating system, the Green Building Initiative's Green Globes rating system, or an equivalent rating system. Permits waiver of the standards by the Capital Development Board or another agency. Specifies the criteria for waivers. Requires the Board to analyze and evaluate the Act's green building standards after the earlier of 5 years or the completion of 10 Board green projects. Effective immediately.

HB 1200: STATE CONTRACT DURATION (Assigned 2/18/2009)
Amends the Illinois Procurement Code. Specifies that the 10-year limit on the duration of State contracts and leases is inclusive of proposed renewals. Effective July 1, 2009.

HB 942: ALTERNATE FUELS-NOTICE (Assigned 2/18/2009)
Amends the Alternate Fuels Act. Provides that, beginning July 1, 2009 and through June 30, 2013, the Secretary of State must notify each owner of a licensed motor vehicle that many motor vehicles are capable of using E85 blended fuel. Requires the notice (i) to be included on the motor vehicle sticker renewal form mailed to motor vehicle owners by the Secretary of State and (ii) to state that "E85 blended fuel reduces reliance on foreign oil and supports Illinois agriculture." Effective immediately.

HB 852: DCEO-TOURISM-COMPUTER KIOSKS (Assigned 2/18/2009)
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that, subject to appropriation, the Department of Commerce and Economic Opportunity, in consultation with the Department of Transportation, may establish and administer a test program to place at rest areas along highways computer kiosks that provide information on tourism activities in the State. Sets forth the requirements of the test program.

HB 1115: INS CD - CREATE DEPT OF INS (Assigned 2/18/2009)
Amends the Department of Insurance Law of the Civil Administrative Code of Illinois. Provides that Executive Order No. 2004-6 is superseded by the Act. Abolishes the Division of Insurance within the Department of Financial and Professional Regulation and creates the Department of Insurance. Transfers all the powers, duties, rights, and responsibilities of the Division of Insurance within the Department of Financial and Professional Regulation to the Department of Insurance. Effective July 1, 2009.

HB 570: BUDGET/LONG-TERM PLANNING (Assigned 2/11/2009)
Amends the State Budget Law of the Civil Administrative Code of Illinois. Requires the Governor's budget to include projections of revenues and expenditures for the 5 following fiscal years. Sets forth requirements for the projections. Requires the budget for the next fiscal year to set forth new or expanded expenditures of $1,000,000 or more. Requires the Governor's Office of Management and Budget to review previous projections and compare them to actual receipts and expenditures. Requires the Governor to submit 5-year projections for expenditures not included in the Governor's initial budget before the General Assembly approves appropriation bills. Contains other provisions. Amends the Fiscal Note Act to require a 5-year projection of expenditures if the note indicates an increase of expenditures of $1,000,000 or more. Effective immediately.

HB 573: BUDGET-FINANCE TRANSPARENCY (Assigned 2/11/2009)
Amends the Governor's Office of Management and Budget Act. Requires the Office to provide to the legislative leaders and the Comptroller and Treasurer copies of all State financial information submitted to persons not employed by the State and to post the information on its website. Requires the Office to submit quarterly financial reports and to post the reports on its website. Sets forth requirements for disclosure and reporting. Effective immediately.

HB 588: PUBLIC SERVICE ACCOUNTABILITY (Assigned 2/11/2009)
Creates the Public Service Accountability Act. Specifies the conditions under which a State executive branch agency may enter into a contract with a private entity for the performance of services currently performed by public employees. Imposes conditions on any rulemaking authority.

HB 616: PROMPT PAYMENT-CARE PROVIDERS (Assigned 2/11/2009)
Amends the State Prompt Payment Act. Defines "qualified provider" as (i) an organization that provides non-residential services for the elderly or for the prevention, intervention, or treatment of mental illness, developmental disabilities, or alcoholism or substance abuse or (ii) an entity licensed under the Community-Integrated Living Arrangements Licensure and Certification Act; but does not include a licensed hospital. Provides that a properly prepared voucher request to the Office of the Comptroller for payment to a qualified provider shall be given priority by the Comptroller for processing and warrant issuance after debt service obligations and payroll obligations of the State have been met unless the Comptroller deems that other obligations of the State must be satisfied prior to these categories of payment. Provides that, if at any time the Comptroller determines that there are insufficient funds available to process priority payments, then vouchers shall be processed and paid out in a first-in, first-out manner as corresponding funds become available. Effective immediately.

HB 639: ICC-OPEN MEETINGS (Assigned 2/11/2009)
Amends the Open Meetings Act and the Public Utilities Act to provide that, for the purposes of the Illinois Commerce Commission only, "meeting" includes any gathering, whether in person or by video or audio conference, telephone call, electronic means (such as, without limitation, electronic mail, electronic chat, and instant messaging), or other means of contemporaneous interactive communication, of one or more members of the Illinois Commerce Commission and a representative of a public utility held for the purpose of discussing public business. Further amends the Public Utilities Act to require that the Attorney General and any interested consumer organizations, upon request, must be given the opportunity to present oral arguments on the propriety of any proposed rate or other charge, classification, contract, practice, rule, or regulation at a hearing on the matter.

HB 767: LEGISLATIVE OFFICE ALLOWANCE (Assigned 2/11/2009)
Amends the General Assembly Compensation Act. Increases the base allowance for House members to $75,000 and Senate members to $87,000 beginning July 1, 2009 with annual cost of living increases beginning July 1, 2010 (instead of $61,000 for House members and $73,000 for Senate members beginning July 1, 2001 with annual cost of living increases beginning July 1, 2002). Effective immediately.

HB 814: FINANCE--INTEREST PAYMENTS (Assigned 2/11/2009)
Amends the State Prompt Payment Act. Removes a provision that requires vendors to initiate a written request for the payment of an interest penalty that is at least $5 but less than $50. Removes a provision that authorizes the Department of Central Management Services and the State Comptroller to adopt rules establishing when interest penalties of less than $5 may be claimed and paid. Effective July 1, 2009.

HB 831: PUBLIC ACCESS COUNSELOR (Assigned 2/11/2009)
Creates the Public Access Counselor and Formal Complaint Act. Establishes the Governor-appointed position of public access counselor to receive inquiries and publish interpretive and educational materials about the Freedom of Information Act and the Open Meetings Act. Requires the counselor to receive complaints and issue advisory opinions on denials of access to public records and public meetings. Provides for the operation of the counselor's office.

HB 683: CMS-ACCOUNTABILITY PORTAL (Assigned 2/11/2009)
Amends the Department of Central Management Services Law. Requires the Department to establish and maintain a website known as the Illinois Accountability Portal. The website shall provide direct access to information concerning State employees and individual consultants, State expenditures, State tax credits, State contracts, revocations and suspensions of occupation and use tax certificates of registration and professional licenses, recipients and uses of appropriations initiated by or on behalf of General Assembly members, and recipients and uses of the Governor's lump sum appropriations. Effective immediately.

HB 769: EXEC ORDER FISCAL IMPACT (Assigned 2/11/2009)
Amends the State Finance Act. Requires that each July 31 the Governor must report to the General Assembly and the public upon the fiscal impact of all executive orders issued or signed during the previous fiscal year. Specifies the items that must be included for each executive order to reflect the cost of implementing, administering, and enforcing the order and the percentage of those costs borne by current and future appropriations. Effective immediately.

HB 770: STORAGE TANK FUND-SWEEPS (Assigned 2/11/2009)
Amends the Environmental Protection Act. Provides that the Underground Storage Tank Fund is not subject to sweeps, administrative charges or charge-backs, or any other fiscal or budgetary maneuver that would in any way transfer any funds from the Underground Storage Tank Fund into any other fund of the State. Effective immediately.

HB 796: DCEO-LIHEAP TRANSFER (Assigned 2/11/2009)
Amends the Illinois Economic Opportunity Law, the Energy Assistance Act, and the Good Samaritan Energy Plan Act. Transfers the administration of the low-income energy assistance program (LIHEAP) and the weatherization assistance program from the Department of Healthcare and Family Services to the Department of Commerce and Economic Opportunity. Provides that the income limit for program eligibility set by the Department may not exceed the amount established by the federal Office of Management and Budget or 75% of the State median income, whichever is greater (now, may not exceed 150% of the federal nonfarm poverty level).

Amends the State Finance Act. Exempts the Domestic Violence Shelter and Service Fund from the Act's administrative charge-back provisions. Effective immediately.

HB 820: MILITARY CODE-VARIOUS (Assigned 2/11/2009)
Amends the Military Code of Illinois. Provides for the Adjutant General (i) to order Illinois National Guard personnel into active service for certain nonemergency functions and (ii) to make rules concerning military installations in conformity with federal rules. Provides for personnel to receive medical and dental treatment for injuries incurred "while on duty and lawfully performing the same" and to be treated for injuries, wounds, and disabilities at the nearest appropriate medical facility if a medical officer is not detailed. Provides for payment of medical treatment by the State.

HB 798: DCEO-ECON DEVELOPMENT GRANTS (Assigned 2/11/2009)
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Requires the Department of Commerce and Economic Opportunity to develop a program to make grants to local development organizations. Provides that under this program, a county or municipality may apply to the Department for a grant to be awarded to a local development organization in that county or municipality for the purpose of fostering local or regional economic development. Provides that these grants are subject to appropriation and sets forth the purposes for which the grants may be used. Provides that an organization is not eligible to receive grant moneys under the program if it has publicly endorsed any political candidate or if it distributes political questionnaires. Provides that documents produced under the grant program are subject to the provisions of the Freedom of Information Act. Effective on January 1, 2010.

HB 669: VEH CD-FIRE CHIEF PLATE FEE (Assigned 2/11/2009)
Amends the Illinois Vehicle Code. Provides that the registration fee for fire chief vehicles owned by the fire chief is the same as the standard registration fee, and the registration fee for fire chief vehicles owned by a municipal fire department or fire protection district is the same as the reduced registration fee for units of local government. Effective immediately.

Amends the Design-Build Procurement Act. Eliminates the Act's July 1, 2009 repeal provision. Effective immediately.

HB 440: LOBBYING-ELECTED OFFICIALS (Assigned 2/9/2009)
Amends the Lobbyist Registration Act. Provides that a person required to register under the Act is ineligible to hold an elective State or local office. Provides that the holder of an elective State or local office may not engage in activities that would require registration under the Act.

HB 447: MOTOR VEHICLE RECORD SEARCHES (Assigned 2/9/2009)
Amends the Illinois Vehicle Code, Labor and Storage Lien Act, Labor and Storage Lien (Small Amount) Act, and Sale of Unclaimed Property Act to provide a process of providing notice to motor vehicle owners and lienholders prior to auction sale or impoundment. Provides that a towing service or person seeking to foreclose on a lien must contact the Secretary of State and request that the Secretary search the vehicle registration records of the State of Illinois for information relating to the owner of the vehicle and lienholders of record. Provides that in event the Secretary of State does not find any record of the motor vehicle, the towing service or person seeking to foreclose on a lien must search a national vehicle record information service and search the vehicle for any evidence relating to an owner or lienholder. Provides that any owner or lienholder identified by the procedures in this Act must be given notice of the motor vehicle impoundment or auction sale. Provides that the failure to perform the procedures in this Act will render any subsequent sale voidable by a court of competent jurisdiction. Reorganizes a provision of the Illinois Vehicle Code relating to record searches by deleting and adding the same language in different locations. Effective immediately.

HB 453: HOMEOWNER EMERGENCY ASSIST ACT (Assigned 2/9/2009)
Creates the Illinois Homeowner's Emergency Assistance Program Act. Contains provisions concerning the powers and duties of the Illinois Housing Development Authority with respect to the Act, the eligibility of a homeowner for assistance under the Act, the assistance payments for eligible homeowners, and funding for the program. Provides that the Act is repealed on January 1, 2011. Effective immediately.

HB 464: PROMPT PAY-45 DAYS (Assigned 2/9/2009)
Amends the State Prompt Payment Act. Provides that interest is payable to vendors beginning 45 days (instead of 60 days) after receipt of a proper bill or invoice.

HB 492: ADMIN PRO-SMALL BUSINESS (Assigned 2/9/2009)
Amends the Illinois Administrative Procedure Act. Requires that the economic impact analysis for a proposed rule affecting small businesses be prepared by the agency promulgating the rule (now, the Business Assistance Office of the Department of Commerce and Economic Opportunity). Requires each agency to perform periodic reviews of its rules in order to evaluate their affect upon small businesses.

HB 289: STATE AUDITING ACT-TECH (Assigned 2/9/2009)
Amends the Illinois State Auditing Act. Provides for the establishment and operation within the Office of the Auditor General of an Appropriations Earmark Unit to conduct performance audits of earmarked appropriations that become law. Requires operation of a telephone hot line to receive anonymous suggestions for audits of grant programs and earmarked appropriations. Requires the audits to be public records and filed with the Legislative Audit Commission. Requires a majority vote of the Commission in order to direct the Auditor General to cease conducting an audit. Effective July 1, 2009.

HB 379: PROCUREMENT-REVERSE AUCTION (Assigned 2/9/2009)
Amends the Illinois Procurement Code. Authorizes State purchasing officers under the jurisdiction of the Director of Central Management Services to use an electronic reverse auction procurement method for purchases of supplies and services other than professional and artistic services. Requires that the method comply with rules adopted by the Director and that the purchasing officer first explain in writing to the Director his or her determination that use of the method will be in the State's best interest. Effective immediately.

HB 446: ID CARD-SOS-SIGNATURE OR MARK (Assigned 2/9/2009)
Amends the Illinois Identification Card Act. Requires the Secretary of State to affix the signature or mark of the applicant for standard Illinois Identification Cards and Illinois Disabled Person Identification Cards, rather than requiring each applicant to affix his or her signature to the card upon receipt and prior to its use for any purpose.

HB 480: STATE MILEAGE REIMBURSE RATE (Assigned 2/9/2009)
Amends the State Finance Act. Provides that for personnel under the jurisdiction of the State travel control boards, the allowance rate for automobile travel mileage reimbursement, which is the same as the rate set by federal regulations, shall be increased or decreased during the State's fiscal year as of the effective date of the federal regulations (now, increases do not take effect until the next July 1).

HB 489: MEDICAL PROVIDER DEFERRED COMP (Assigned 2/9/2009)
Amends the Illinois Pension Code, the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Public Aid Code. Allows a medical or health care provider who participates under the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, or the Public Aid Code to elect, in lieu of receiving direct payment for goods or services provided, to participate in the health care provider deferred compensation plan. Requires the State Board of Investment to develop and establish and the Department of Central Management Services to administer a deferred compensation plan for health care providers under the same terms and conditions as the State Employee Deferred Compensation Plan. Provides that a medical or health care provider who elects to participate in the plan does not have a cause of action against the State for any damages allegedly suffered by the provider as a result of any delay by the State in crediting the amount of any contribution to the provider's plan account. Effective January 1, 2010.

HB 4: FACILITIES CLOSURE-COGFA (Assigned 2/4/2009)
Amends the State Facilities Closure Act. Provides that a recommendation of closure of a State facility may not be implemented unless the Commission on Government Forecasting and Accountability, by resolution adopted by record vote of at least 8 members, approves the recommendation (now, the Commission's opinion is merely advisory). Provides that nothing in the Act precludes the executive branch agency recommending closure from providing relevant information to the affected State employees and their authorized bargaining representatives. Effective immediately.

HB 6: ST AGENCY GA ACCOUNTABILITY (Assigned 2/4/2009)
Creates the State Agency Director Legislative Accountability Act. Requires that each director, secretary, assistant director, and assistant secretary of each State agency subject to the jurisdiction of the Governor's Executive Inspector General must be present in Springfield during each legislative session day. Prohibits anyone other than those persons from appearing or testifying before a legislative committee on behalf of their State agencies unless otherwise provided by the committee or by law. Effective immediately.

HB 65: STATE EMPLOYMENT APPLICATION (Assigned 2/4/2009)
Creates the State Employment Application Act. Provides that an application for State employment may not contain any question as to whether the applicant was convicted of or placed on supervision for a non-violent criminal offense but must contain a question as to whether the applicant for State employment has ever been convicted of a violent offense that is classified as a felony. Provides that nothing in the Act shall be construed to prohibit a State agency from conducting a criminal background check of an applicant for State employment. Provides that if a federal or State law disqualifies a person convicted of certain offenses from holding a position, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that if an applicant is applying for a position of peace officer, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that nothing in the Act prohibits a decision to refuse to hire on the basis that the applicant has been convicted of a criminal offense. Effective immediately.

HB 82: GAMING BD-REMOVE FRM REVENUE (Assigned 2/4/2009)
Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Riverboat Gambling Act. Separates the Illinois Gaming Board from the Department of Revenue for the purposes of enforcing and administering the Riverboat Gambling Act. Makes conforming changes. In provisions concerning the powers and duties of the Board, removes language allowing the Director of Revenue to delegate responsibility for the administration and enforcement of certain Acts concerning gaming to the Board and adds language concerning appointing investigators and contracts. Makes changes concerning appropriations from the State Gaming Fund. Makes other changes. Amends the Executive Reorganization Implementation Act. Excludes the Illinois Gaming Board from the definition of "agency directly responsible to the Governor". Effective July 1, 2009.

HB 239: FINANCE-ROAD FUND (Assigned 2/4/2009)
Amends the State Finance Act. Provides that no appropriations from the Road Fund may be made to the Department of Central Management Services, the Department of Employment Security, the Department of Revenue, the Court of Claims, or any other State agency (other than the Department of State Police, the Department of Transportation, and the Secretary of State) in FY09 or thereafter. Those transfers must be made from the General Revenue Fund instead. Provides that no further transfers may be made from the Road Fund or the State Construction Account Fund to the General Revenue Fund. Effective immediately.

HB 240: CORRECTIONAL FACILITIES (Assigned 2/4/2009)
Amends the State Facilities Closure Act. Creates the Correctional Facilities Panel. Provides that the Panel shall perform a detailed examination of the State's correctional facilities and the respective populations and workforces of the facilities. Sets forth the membership of the panel. Provides that no correctional facility managed or operated by the Illinois Department of Corrections may be closed, eliminated, or otherwise required to reduce its 2008 average daily population or average daily workforce by more than 20% prior to the completion of the submission of the final report by the Correctional Facilities Panel. Effective immediately.

HB 286: ST ETHICS-PUBLIC SERVICE ADS (Assigned 2/4/2009)
Amends the State Officials and Employees Ethics Act. Prohibits a public service announcement on behalf of a State administered program that contains the proper name, image, or voice of a State executive branch constitutional officer or legislator from being displayed on a billboard or electronic message board. With respect to the transfer of books, serial publications, and other library materials to which the Act's transfer procedures do not apply, (i) adds those items that have been withdrawn from the transferring agency's library collection through a regular collection evaluation process and (ii) adds non-profit agencies, whether located in or outside Illinois, to the list of entities to which such items may be transferred. Authorizes an agency with withdrawn books, serial publications, or other library materials to sell those items to the public at library book sales or to book dealers or to offer those items through exchange to book dealers or to organizations. Provides that revenues generated from such sales shall be (i) retained by the agency and used for the purchase of library materials or (ii) in the case of the State Library, deposited into the State Library Fund. Effective immediately.

HB 194: GOMB-FUNDS-TRANSPARENT WEBSITE (Assigned 2/4/2009)
Amends the Governor's Office of Management and Budget Act. Requires GOMB to establish a single updated searchable database website accessible by the public at no cost that includes information concerning each entity that receives Illinois funding. Requires GOMB to report to the General Assembly concerning the website. Effective immediately.

HB 228: VEH CD-SOIL & WATER DIST PLATE (Assigned 2/4/2009)
Amends the Illinois Vehicle Code and the State Finance Act. Provides for the issuance of Soil and Water Conservation District license plates. Provides that, in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $40 at original issuance and $27 at renewal. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $25 of the additional original issuance fee and the renewal fee shall be deposited into the Soil and Water Conservation District Fund, a new special fund in the State treasury that shall be used for grants to Illinois soil and water conservation districts for projects that conserve and restore soil and water in Illinois, and provides that State Finance Act provisions allowing the transfer of moneys from other funds into the General Revenue Fund does not apply to moneys deposited into the new Fund.

HB 247: VEH CD-IN GOD WE TRUST PLATES (Assigned 2/4/2009)
Amends the Illinois Vehicle Code. Provides for the issuance of In God We Trust license plates, for an additional charge of $20 at initial issuance and at renewal. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $5 of the original issuance fee and $18 of the renewal fee shall be deposited into the Illinois Military Family Relief Fund.

HB 310: MEMBER INITIATIVE-CAPITAL (Assigned 2/4/2009)
Amends the State Finance Act. Provides that each appropriation for a legislative member initiative must be by a separate line item appropriation that fully describes the legislative member initiative. Provides that no legislative member initiative may be funded through a lump sum appropriation. Provides that an appropriation for a legislative member initiative or a capital improvement is released and available for expenditure as a matter of law; and authorizes enforcement by mandamus maintained by any member of the General Assembly. Defines "legislative member initiative" and "capital improvement".

HB 52: VEH CD-DISABLED VET PLATES (Assigned 2/4/2009)
Amends the Illinois Vehicle Code. Deletes provisions requiring a 100% disability and eligibility for the purchase of a vehicle by the federal government as conditions for eligibility for disabled veterans' registration plates. Replaces the deleted provisions with provisions requiring that the veteran hold proof of a service-connected disability from the United States Department of Veterans Affairs and that a licensed physician, physician assistant, or advanced practice nurse has certified that the veteran qualifies for issuance of registration plates or decals to a person with disabilities. Repeals a provision that authorized the issuance of handicapped veterans' registration plates to disabled veterans who have less than 100% disability and are eligible for the purchase of a vehicle by the federal government. Deletes cross-references to the repealed provision.

HB 77: FLAG DISPLAY-FIREFIGHTER DEATH (Assigned 2/4/2009)
Amends the Flag Display Act. Requires that the U.S. national and Illinois State flags be displayed at half-staff when an Illinois firefighter is killed in the line of duty. Effective immediately.

HB 37: LEASE CLOSED STATE PARKS (Assigned 2/4/2009)
Creates the Lease of Closed State Properties Act. Requires that the Department of Natural Resources and the Illinois Historic Preservation Agency offer to lease to any interested unit of local government, non-profit organization, or public or private college or university the operation and maintenance of any closed State park or historic site for one dollar. Provides that the leasing entity shall retain all revenues generated by such operation during the term of the lease. At the end of the lease, requires the State to reimburse the leasing entity for the undepreciated portion of any improvements made or paid for by the entity. Effective immediately.

HB 47: FOIA-DISABILITY DATABASES (Assigned 2/4/2009)
Amends the Freedom of Information Act. Exempts from the Act's copying and inspection requirements data of law enforcement agencies on the mental and physical disabilities, defects, and maladies of individuals maintained for the safety of responding law enforcement officers, the individuals, and the public. Contains a non-acceleration clause.

HB 88: LOBBYIST REGISTRATION FEE (Assigned 2/4/2009)
Amends the Lobbyist Registration Act. Makes the annual registration fee $150 for any entity qualified under Internal Revenue Code Section 501(c) (now, $150 for entities qualified under Section 501(c)(3) and $350 for entities qualified under any other provision of Section 501(c)). Effective July 1, 2009.

HB 276: ADMIN PROCEDURE-GRANT RULES (Assigned 2/4/2009)
Amends the Illinois Administrative Procedure Act. Provides that, unless specified otherwise in the Act, a State agency subject to the Act is not exempt from adopting rules pursuant to the Act covering the agency's statements of general applicability with respect to law or policy affecting persons or entities outside the agency, including grant-making policy. Requires that all State agencies subject to the Act with grant-making authority must adopt rules governing the various aspects of the grant-making process. Effective immediately.

HB 5: LOBBYIST-NO STATE AGENCIES (Assigned 2/4/2009)
Amends the Lobbyist Registration Act. Prohibits a person subject to the Act from accepting compensation from a State agency for lobbying legislative action. Exempts the salaries of full-time State employees with responsibilities or authority other than lobbying.

HB 237: PROMPT PAYMENT-PENALTY (Assigned 2/4/2009)
Amends the State Prompt Payment Act. Provides that any bill submitted under Article V of the Illinois Public Aid Code approved for payment must be paid or the payment issued to the payee within 30 days (now, 60 days) after receipt of a proper bill or invoice, and, if payment is not issued to the payee within this 30-day period, an interest penalty of 2.0% (now, 1.0%) of any amount approved and unpaid shall be added for each month or fraction thereof after the end of this 30-day period, until final payment is made.
